Marine Ecosystem Management & (And) A Post-Sovereign Transboundary Governance, Bradley Karkkainen Nov 2004

Marine Ecosystem Management & (And) A Post-Sovereign Transboundary Governance, Bradley Karkkainen

San Diego International Law Journal

This paper argues that for purposes of managing transboundary environment problems in general, and marine ecosystems in particular, the role of international law as traditionally understood is somewhat overrated. Binding international legal obligations owed by states to other states often turn out to be a good deal less important in environmental problem solving than is commonly supposed by many international lawyers, legal scholars, and environmental NGOs (non-governmental organizations). Specifically, this paper argues that emphasis on binding multilateral environmental agreements among sovereign states is often misplaced and possibly even counterproductive, insofar as it threatens to divert attention from more promising strategies …

Water is one of the scarcest natural resources on our planet. Yet, it is one of humans' most vital needs This gift of nature has been a cause of tension and confrontation in many parts of the world due to the lack of a shared vision for its optimal and rational use Among the great water bodies, the Nile basin has been cited as one of the major trouble spots Recently, the Nile basin states have started to cooperate under the auspices of the Nile Basin Initiative for sustainable and equitable approach to Nile water use. Who Gets The Hooch?: Georgia, Florida, And Alabama Battle For Water From The Apalachicola- Chattahoochee-Flint River Basin, C. Hansell Watt Iv

Mercer Law Review

During a time when technology is constantly changing and becoming more advanced, one of the constants that our planet, and all of the creatures on it, will always rely upon is fresh water. Throughout history, rivers have been the lifeblood that supports cities by providing drinking water, irrigation, transportation, trade, recreation, power, and many other industrial and domestic uses. As the human population grows, rivers and lakes are more pressured to support the growing needs of the communities and cities that rely on these bodies of water. Because many rivers in the United States flow across numerous states, problems develop …

Is Fifra Enough Regulation? Failure To Obtain A Npdes Permit For Pesticide Applications May Violate The Clean Water Act, Rebecca E. Leintz

Chicago-Kent Law Review

In the summer of 1999, West Nile Virus, a mosquito-borne illness, appeared in the eastern United States and has since worked its way across the country. Thousands have been infected, and hundreds have died from the virus. Communities, struggling to protect their residents, have often been forced to employ widespread pesticide spraying to stop the virus' spread. Citizens and environmental groups, however, have expressed concern that pesticide spraying is damaging to the environment and contend that the law has been broken. They argue that when these pesticides are deposited onto water bodies, without first obtaining a permit, there is a …

State V. Colosimo: Minnesota Anglers’ Freedom From Unreasonable Searches And Seizures Becomes “The One That Got Away”, Edwin J. Butterfoss, Joseph L. Daly

William Mitchell Law Review

This article examines the various opinions in the Colosimo case, including the opinion of the Minnesota Court of Appeals (which was reversed by the supreme court), as well as the majority, concurring, and dissenting opinions of the supreme court. The article provides a brief background of how the issue of stops and inspections by conservation officers has been dealt with in other jurisdictions before turning to a critique of the Minnesota Supreme Court's decision in Colosimo, which the authors consider far too expansive. The decision in Colosimo undermines the right of citizens of Minnesota to be free from invasions of …
