The Genographic Project: Traditional Knowledge And Population Genetics, Matthew Rimmer

This article considers the debate over patent law, informed consent, and benefit-sharing in the context of biomedical research in respect of Indigenous communities. In particular, it focuses upon three key controversies over large-scale biology projects, involving Indigenous populations. These case studies are representative of the tensions between research organisations, Indigenous communities, and funding agencies. Section two considers the aims and origins of the Human Genome Diversity Project, and criticisms levelled against the venture by Indigenous peak bodies and anti-biotechnology groups, such as the Rural Advancement Foundation International. Fitness For Trial In The District Court: The Legal Perspective, Darius Whelan

This paper concentrates on fitness for trial in the District Court and deals with the topic under two main headings: firstly, how does the District Court determine fitness for trial and secondly, the consequences of a finding of unfitness for trial. Ireland's Criminal Law (Insanity) Act 2006 introduced significant reforms to this area of law, and the implications for the District Court are reviewed.

The Regulation Of Xenotransplantation In The Uk After Ukxira: Legal And Ethical Issues’, Laura Williamson, Marie Fox, Sheila Mclean

Xenotransplantation - the transfer of living tissue between species - has long been heralded as a potential solution to the severe organ shortage crisis experienced by the United Kingdom and other `developed' nations. However, the significant risks which accompany this biotechnology led the United Kingdom to adopt a cautious approach to its regulation, with the establishment of a non-departmental public body - UKXIRA - to oversee the development of this technology on a national basis. In December 2006 UKXIRA was quietly disbanded and replaced with revised guidance, which entrusts the regulation of xenotransplantation largely to research ethics committees. In this …

Mental illnesses and disorders affect many people around the world annually, but unfortunately infrastructures and systems are not in place to adequately address these issues as much as they are for somatic diseases and ailments. Mental Health Parity Law seeks to equalize and improve available and accessible mental health treatment with medical care by mandating insurance and payment provisions. Mental Health Parity Law exists at federal and most state levels, however, federal and many state laws are not as inclusive and comprehensive as is necessary to fully reap the benefits of increased quality and affordable mental healthcare.
