The COVID-19 pandemic has exposed preexisting weaknesses in many areas of life and the law. In April 2021, the ABA published a study entitled Practicing Law in the Pandemic and Moving Forward: Results and Best Practices From a Nationwide Survey of The Legal Profession. The results of this study confirmed what many women and people of color already knew – standard approaches to the workplace do not serve goals of diversity and inclusion, especially during times of great stress and financial uncertainty.

This book chapter, which was published in 2000, provides an overview of legal ethics education in U.S. law schools. Since 1974, legal ethics instruction has been required in law schools by the major accrediting body for law schools. The methods by which this require­ment has been satisfied vary, but the result is a much richer ethics literature than existed previously and a variety of approaches to the topic. This book chapter begins with an overview of the regulation of U.S. lawyers. The second section discusses the history of the legal ethics course requrirement. A fundamental principle of professional labor is that the members of a specialized occupation, as professionals, enjoy autonomy. In sociologist Elliot Freidson's words, professionals “control their own work.” The practitioners themselves decide what constitutes acceptable or appropriate behavior. Professions establish rules and systems of self-regulation to teach and enforce the expected standards of conduct on their members.
