How Lawyers Manage Intragroup Dissent, Scott L. Cummings

This essay, adapted from the keynote speech for the conference, reflects upon how lawyers respond to dissent within social movements—over the goals of social change efforts and the means of pursuing them. Drawing upon case studies from the LGBT rights and labor contexts, it describes specific challenges to managing dissent within “top-down” and “bottom-up” lawyering models. From the top-down, it explores how lawyers in the California marriage equality movement addressed repeated legal challenges over litigation tactics. Copyright law rewards an artificial monopoly to individual authors for their creations. Whistleblowers should not be required to pick their poison. They should not be penalized for following the law, particularly where, as here, the alleged “wrong” relied upon by the Second Circuit Court of Appeals was Petitioner’s compliance with the Act’s sealing provision. See 31 U.S.C. § 3730(b)(2) That provision expressly requires whistleblowers to maintain the confidentiality of qui tam lawsuits during the pendency of a government investigation. Petitioner followed the Act’s express mandate—and suffered the consequences.

This article looks at the ethical and diversity implications of high billable hour requirements. While corporate counsel have increasingly demanded a diverse legal workforce and emphasized the need to lower the costs of outside counsel, law firms have not responded to these concerns in a manner that is producing results. Instead, women continue to drop out of law firm practice at higher rates than their male counterparts and the costs of legal services remain high. High billable hour requirements exacerbate both these problems and have implications as well for ethical lawyering. Using data from a variety of disciplines, the article …
