O presente ensaio pretende demonstrar a importância do contraditório diante da análise desenvolvida pelo juiz sobre vícios no processo. Sendo que o direito de influencia e o dever de diálogo são exigências próprias da estruturação do procedimento no marco do Estado Constitucional, ao juiz é absolutamente vedado pronunciar-se (favorável ou desfavoravelmente) sobre os vícios no processo sem antes permitir a participação das partes.

The U.S. Supreme Court seems intent on taking another look at affirmative action in higher education. What could this mean for colleges and universities? This blawg post offers no definitive answers, but points out that arguments exists for both sides of the issue through a recent legal development: Iqbal & Twobly's Plausibility Doctrine. If the Doctrine forces a transative duty on case law, then affirmative action programs' legal rationale - long decried for not making logical sense - could suffer. This essay intends to build an historical-legal analysis about the evolution of the nullity in civil procedure law, showing a progressive flexibilization of the legal formalism. The investigation covers Roman Law, Middle Age, the most important codifications of 19th Century, and finally arriving in the model adopted by the italian Code of Civil Procedure, which severely influenced the regulation of the nullity in the peruvian Code.

In its most recent term, the Supreme Court decided Pearson v. Callahan and Ashcroft v. Iqbal, two cases that, even at this early date, can safely be called “game-changers.” What is fairly well known is that Iqbal and Pearson, on their own terms, will hurt civil rights plaintiffs. A point that has not been explored is how the interaction between Iqbal and Pearson will also hurt civil rights plaintiffs. First, the cases threaten to catch plaintiffs on the horns of a dilemma: Iqbal says, in effect, that greater detail is required to get allegations past the motion to dismiss stage. …

The Failure Of Adversary Process In The Administrative State, Bryan T. Camp

In a series of hearings in 1997 and 1998, Congress heard allegations that the Internal Revenue Service (“IRS” or “Service”) was abusing taxpayers during the process of collecting taxes. The resulting distrust of the tax bureaucracy led Congress to create a special adversary proceeding providing for judicial review of IRS collection decisions. The proceeding is beguilingly titled “Collection Due Process” (and commonly referred to as “CDP”). My study of CDP’s structure, operation, and of 976 court decisions issued through the end of 2006 demonstrates that it has failed to fulfill its promise.
