The Communications Decency Act: Immunity For Internet-Facilitated Commercial Sexual Exploitation, Haley C. Halverson
Dignity: A Journal of Analysis of Exploitation and Violence
This paper reviews the original intent and historical application of the Communications Decency Act (CDA), most notably Section 230, with special regard to cases of Internet-facilitated commercial sexual exploitation. Although the CDA was originally created to protect children online, Section 230 of the CDA has been interpreted by the courts to grant broad immunities to websites facilitating the sexual exploitation of children and adults alike. Through analyzing the genesis and evolution of the CDA, it becomes clear that court interpretations of Section 230 are starkly inconsistent with original Congressional intent, and that the primary way to avoid de facto decriminalization …

Amnesty International's Empty Promises: Decriminalization, Prostituted Women, And Sex Trafficking, Darren Geist
Dignity: A Journal of Analysis of Exploitation and Violence
Through a close examination of Amnesty International’s (Amnesty) own arguments and sources, this paper demonstrates that Amnesty’s proposal to decriminalize prostitution or “sex work” will harm those it claims to help. It concludes that the best available evidence indicates that decriminalization of prostitution would: increase sex trafficking, leave prostituted women or “sex workers” more vulnerable to violence, and reduce access to healthcare, protection, and services. Prostituted women primarily enter the industry at a young age, often suffering from a history of sexual and physical abuse, coming from marginalized and vulnerable communities, and driven by emotional and economic desperation. Moving Beyond "Slaves, Sinners, And Saviors": An Intersectional Feminist Analysis Of Us Sex-Trafficking Discourses, Law And Policy, Carrie N. Baker
Journal of Feminist Scholarship
This article analyzes stories and images of sex trafficking in current mainstream US public discourses, including government publications, NGO materials, news media, and popular films. Noting the similarities and differences among these discourses, the first part demonstrates that they often frame sex trafficking using a rescue narrative that reiterates traditional beliefs and values regarding gender, sexuality, and nationality, relying heavily on patriarchal and orientalist tropes. Reflecting this rescue narrative, mainstream public policies focus on criminal justice solutions to trafficking. The second part suggests alternative frameworks that empower rather than rescue trafficked people. The article argues that the dominant criminal justice …
