It is undeniable that the United States ("U.S.") has experienced significant social changes within the past 150 years. Social progress has been made regarding issues related to both race and gender. For example, until the 1870s, men were legally entitled to physically chastise their wives. It was just a decade prior to this that slavery had been abolished. At the root of these issues was the notion that women and people of color were not autonomous holders of rights, but rather were "property" that belonged to their owners or partners. Article 16 of the United Nations Convention on the Rights of Child (UNCRC) broadly entitles children to protections of their privacy and reputations. Under the UNCRC, nations have pledged to uphold any protections necessary to protect children against such attacks or interference regarding their honor and reputation. Among the 196 member states of this convention, very few have specific legislation dedicated to protecting children's privacy rights. Educational inequities can affect someone's future; school choice is meant to bridge the gap between those that receive a better education and those unable to receive one due to financial hardships to ensure a better future for students. While in numerous occasions school choice is a student's saving grace from a failed system, regulations must be in place to ensure that the people that are being helped by the law are those who need it, not just want it. Razing & Rebuilding Delinquency Courts: Demolishing The Flawed Philosophical Foundation Of Parens Patriae, Eduardo R. Ferrer

Loyola University Chicago Law Journal

Professor Eduardo R. Ferrer of Georgetown University explores the history and background of the juvenile delinquent system in the United States. Professor Ferrer argues that the philosophical underpinnings of our legal youth systems, under the concept of parens patriae, have led to failure with regard to how states care for children that come under their control—and ultimately need to be abandoned in favor of a more effective and just system.

Ignored, Harassed, And Endangered: States Must Provide Gender-Affirming Healthcare To Transgender Youth In Juvenile Detention, Jake Gnolfo

Loyola University Chicago Law Journal

In 2019, the U.S. Court of Appeals for the Ninth Circuit in Edmo v. Corizon, Inc. held a prison’s denial of gender-affirming care to a transgender adult prisoner constituted cruel and unusual punishment under the Eighth Amendment. However, the reality for incarcerated transgender juveniles is much different. It is incredibly hard, if not impossible, for transgender juveniles to obtain access to gender-affirming care while detained. Furthermore, states have begun banning gender-affirming healthcare for all transgender youth. Preliminary injunctions of these laws have been swift and successful; however, transgender juveniles remain left out of the conversation. While being restrained of their …

People seek asylum in the United States (U.S.) when their home country is no longer safe due to persecution or other forms of violence. However, obtaining asylum is a notoriously complicated process due to the numerous government agencies involved, the immigration courts' backlogs, and the possibility of detention while awaiting a hearing. The current U.S. immigration system is itself a large barrier to individuals seeking asylum, and information regarding legal rights and protections are often inaccessible to asylum seekers. In this way, the U.S. immigration officials cause massive injustices against asylum seekers and those who have been granted asylum ("asylees"). …

In the aftermath of the Russian invasion of Ukraine in February 2022, there has been a dramatic increase in Ukrainian family separation. Women and their children were forced to leave their homes and oftentimes their husbands, to seek safety in another country. Family separation was an expected consequence of the war, and in preparation for this disaster, UNICEF trained thousands of people on how to shelter children separated from their families in Ukraine. However, no amount of preparation could have been sufficient to handle the magnitude of Ukrainian family separation that took place within such a short amount of time. …

Since the decision in Dobbs v. Jackson Women's Health Organization overturned Roe v. Wade in 2022, Republican Senators have proposed a new bill, the Unborn Child Support Act, that would allow prospective mothers to request child support from their child's prospective fathers from the moment of conception as determined by a physician. Under the Act, paternity tests are only conducted if the mother consents, and if the safety of the child can be maintained. The bill originates from the idea that life begins at conception, allowing women to receive child support payments while they are pregnant from their child's father …
