Why Paretians Can’T Prescribe: Preferences, Principles, And Imperatives In Law And Policy, Robert C. Hockett

Recent years have witnessed two linked revivals in the legal academy. The first is renewed interest in articulating a normative “master principle” by which legal rules might be evaluated. The second is renewed interest in the prospect that a variant of Benthamite “utility” might serve as the requisite touchstone. One influential such variant now in circulation is what the Article calls “Paretian welfarism.” This Article rejects Paretian welfarism and advocates an alternative it calls “fair welfare.” It does so because Paretian welfarism is inconsistent with ethical, social, and legal prescription, while fair welfare is what we have been groping for …

En una reciente sentencia casatoria, la Sala Civil Permanente de la Corte Suprema ha hecho prevalecer el embargo inscrito frente a la propiedad no registrada. En opinión del autor, esta sentencia, a diferencia de anteriores pronunciamientos, invoca argumentos distintos a los tradicionales, por lo que marca un punto de referencia imprescindible para cualquier análisis de la tendencia jurisprudencial sobre la materia. El autor señala que la impugnación de acuerdos de asociación se refi ere a la categoría de la anulabilidad. Así, el artículo 92 del Código Civil convierte causas de nulidad en causas de anulabilidad, pero la conversión opera dentro de la categoría de los actos colegiales asociativos inválidos, mas no respecto de aquellos actos colegiales asociativos que deben ser considerados como inexistentes. Por ello, considera que los asociados tienen a su disposición los remedios de anulabilidad e inexistencia, dependiendo de la patología que afecte al acto colegial asociativo que se busca cuestionar.

Historical Antecedents Of Challenges Facing The Georgia Appellate Courts, Michael B. Terry

The Georgia appellate courts face challenges common to many courts in these days of reduced governmental resources. At the same time, the Georgia appellate courts face unusual challenges that can be traced to their historical antecedents and one unique constitutional provision: the “Two-Term Rule.” Just as “[t]he law embodies the story of a nation’s development through many centuries,” the current rules and practices of both the Supreme Court of Georgia and the Court of Appeals of Georgia embody the story of the development of those courts since their founding.

This article addresses two distinct yet interrelated topics: the arcane and unnecessarily complex jurisdictional division between the Georgia Supreme Court and Georgia Court of Appeals, and the excessive caseload at the Georgia Court of Appeals.
In Part I.A., this article discusses Georgia’s appellate system—its history, the jurisdictional division that arose, the confusion the current jurisdictional framework creates, and the limitations and burdens it places on Georgia’s highest court. This essay is a critical response to the 2013 commemorations of the75th anniversary of the Federal Rules of Civil Procedure.The Federal Rules of Civil Procedure were introduced in 1938 to provide procedure to decide cases on their merits. The Rules were designed to replace decisions under the “sporting theory of justice”with decisions according to law.

El autor refiere que en la doctrina y en la jurisprudencia existen posiciones disímiles respecto a la interpretación del remedio contenido en el artículo 92 del Código Civil. Así, una postura considera que tal artículo contiene un remedio especial denominado “impugnación” para cuestionar tanto la nulidad y la anulabilidad, en tanto que la otra sostiene que existe un tercer remedio de invalidez negocial distinto a los mencionados. En ese contexto, plantea una tercera posición: el referido artículo recoge el remedio de la anulabilidad, pero –teniendo en cuenta el plazo para poder incoarlo– sería una anulabilidad especial.

The history of the European nation-state, wrote political sociologist Charles Tilly, is inextricably bound up with the history of warfare. To oversimplify Tilly’s nuanced and complex arguments, the story goes something like this: As power-holders (originally bandits and local strongmen) sought to expand their power, they needed capital to pay for weapons, soldiers and supplies. The need for capital and new recruits drove the creation of taxation systems and census mechanisms, and the need for more effective systems of taxation and recruitment necessitated better roads, better communications and better record keeping.
