Global environmental conventions are created to address and resolve global environmental problems. Assessments of the achievement of specific environmental goals, however, indicate that there is room for progress and that stronger collective action is required. Given that there are no empirical instruments to measure implementation and to determine the factors behind individual countries’ results, challenges emerge that require the expansion of existing analytical frameworks around environmental conventions and their role as global governance instruments. Land use law structures the way we make decisions about how we live together and with the world around us. In doing so, it shapes our relationships not only with the people around us, but with the places we inhabit and encounter. This dissertation examines how land use law structures the relations between people and the more-than-human world to uphold the ownership model of property relations and to privilege particular forms of land use. Through documentary and interview-based qualitative research, it presents an eco-relational examination of one of the most contentious land uses in Ontario aggregate mineral extraction.

A combination of the urban heat island effect and a rising temperature baseline resulting from global climate change inequitably impacts socially vulnerable populations residing in urban areas. This dissertation examines distributional inequity of exposure to urban heat by socially disadvantaged groups and minorities in the context of climate justice. Using Cutter’s hazards-of-place model, variables indicative of social vulnerability and biophysical vulnerability are statistically tested for their associations. Biophysical vulnerability is conceptualized utilizing a urban heat risk index calculated from summer 2010 LANDSAT imagery to measure land surface temperature , structural density through the normalized difference built-up index, and vegetation abundance …

South Korea’s low carbon and ‘green growth’ policies possess potential regulatory changes that reduce foreign investors’ interests and legitimate expectations concerning the profitability of their businesses. Although international investment law protects a government’s right to protect legitimate public welfare objectives, such as environmental protection, the investor-State dispute settlement provision allows foreign investors to seek compensation for a country’s law and policies contrary to their interests. On the other hand, investor-State dispute settlement provisions inherently have many problems. This work reviews the Inter-American and European human rights regimes and their abilities to respond to point-source pollution, climate change, and ecosystem conservation. It begins by reviewing leading human rights theories and the development of the relationship between human rights and the environment. It then focuses on European human rights, both under the ECHR and the CFREU, and highlights the ECHR’s ability to respond to instances of point-source-pollution though the right to privacy. The 1973 OPEC Oil Embargo served as a wake-up call for many highly oil dependent countries, including the United States and Denmark. In the wake of the 1973 oil crisis, the U.S. and Denmark had very different policy responses. Denmark identified oil itself as the underlying issue, and quickly transitioned to alternative energy sources, including wind. Today, Denmark is a global leader in renewable energy usage and sustainability. The former El Paso ASARCO Smelting and Refining Co. operated between 1877 and 1999, the pyrometallurgic activity was estimated to have discharged excess of a 1,000 tons of lead (Pb) into the atmosphere from 1969-71. It was estimated 96 tons of (Pb) were emitted on an annual basis from the standing ore and fluid beds. The Environmental Protection Agency (EPA) determined that lead (Pb) is the heavy metal of the highest concentration within the vicinity of the smelter. After the smelter production ceased, flash flooding common to the southwest, such as the 2006 historic flood, increased transportation of superficial contaminants …

The United States’ water systems are interstate in their nature; these systems are governed by Congressional compact agreements. Water compacts have been influenced by common factors that have reverberated throughout the water-web of the country. These impacts varied in their scale, national level federal regulations, such as the Endangered Species Act of 1973, and recent concerns about climate change are macro-scale influences. This dissertation is an environmental history of Detroit, Michigan from the 19th century to the present. Recent scholarship on the history of capitalism has largely ignored the problem of environmental inequality, and the negative externalities of economic growth. In contrast, studies of the environmental justice movement have richly documented race, class, and gender inequalities in environmental risk exposure. However, they have neglected the relationship between the development of the environmental justice movement and the restructuring of American capitalism since the 1970s, including deindustrialization and the shift to neoliberalism.
