This research analyze arrangement regarding implementation of electronic RUPS to respond enactment of Pembatasan Sosial Berskala Besar (PSBB) in Indonesia during COVID-19 pandemic. This is a juridical normative research that will be focused on library research that examine legal principles, systematic system of law, and legal synchronization by analyzing the urgency to issue rules and regulation related to implementation of electronic RUPS. Unless to the public company, there is no technical regulation which specifies implementation of electronic RUPS. A Proportionality-Based Framework For Government Regulation Of Digital Tracing Apps In Times Of Emergency, Sharon Bassan

Times of emergency present an inherent conflict between the public interest and the preservation of individual rights. Such times require granting emergency powers to the government on behalf of the public interest and relaxing safeguards against government actions that infringe rights. The lack of theoretical framework to assess governmental decisions in times of emergency leads to a polarized and politicized discourse about potential policies, and often, to public distrust and lack of compliance.
Such a discourse was evident regarding Digital Tracing Apps (“DTAs”), which are apps installed on cellular phones to alert users that they were exposed to people who …
