Until relatively recent years water rights legislation and litigation has primarily centered in the seventeen arid and semi-arid western states. However, as a result of increased demands on water resources for agricultural, industrial, recreational and public uses, the more humid and traditionally water rich states of the East have expressed concern for and interest in the conservation and regulation of their water resources. A significant number of these states have departed from the common law riparian theory of water use law and have enacted comprehensive regulatory measures, modeled after the water acts common in the western states. The basis of public and private rights in the waters of the State of Michigan is grounded principally in the common law. There has been a scarcity of statutory law on the subject and it is only within the last ten years that any statutes have been enacted which seek to delineate public and private rights.

Plaintiff owned a ranch comprising over 45,000 acres and fronting for six miles on the North Platte river. One and a half miles of the river frontage were taken by eminent domain proceedings for a dam and reservoir. Plaintiff claimed the value of his whole ranch was reduced by the loss of water rights, by the destruction of sheltering trees and brush, by the creation of a potential hazard to cattle, and by the threat of floods from breaking dam or dikes. The question to be discussed in this dissertation is whether or not the upland owners on navigate waters live, by virtue of the position of their land a right of ocean to the free enjoyment of the water in front of the land there of for purpose of navigation.
The question here involved has been considered by many legislatures and courts as well as by many text writers and as a result of such consideration there is a great variety of opinions. I shall in this dissertation direct my attention to the law as believe it be in California.

It is evident that no one hard and fast rule could be applied to all cases, either in city or country, without producing injustice and impolitic results.
