partner liability exemptions when faced with an attempt to pierce the corporate veil and attach individual liability for ongoing business decisions. The issue is that although piercing the corporate veil rule serves as an important tool for holding decision-makers accountable for misconduct in public companies and limited liability companies, the Kuwaiti legislature did not adopt this exemption If the promoter or the partner uses the company for fraudulent or illegitimate purposes, If he treats the company’s funds as his own personal funds, or if he does not separate his personal interest from the company’s interest, or if he causes incurring …

Coping With E-Waste: Prospects Of E-Waste Circular Economy Within The Gcc: Analyzing The Legal Framework On Recycling Of E-Waste Within The Gcc, Ali Saeed Alrobayee
Dissertations & Theses
The GCC has experienced rapid population growth and urbanization in the last 40 years. The rise in population has caused a surge in e-waste within the GCC countries. Electronic waste poses severe health and environmental risks, calling for the adoption of a circular economy where e-wastes are converted into valuable products through recycling. However, achieving a circular economy requires a robust legal framework, technologies and policies as practiced globally. The Global E-waste Monitor has traced e-waste generation in the GCC countries since 2014. One critical finding is that the e-waste generation has surged with population growth, urbanization and the advancement …

Gender Discrimination And Statelessness In The Gulf Cooperation Council States, Betsy L. Fisher
Gender Discrimination And Statelessness In The Gulf Cooperation Council States, Betsy L. Fisher
Michigan Journal of Gender & Law
Using the Gulf Cooperation Council countries as a case study, this Article outlines the ways in which gender and birth status discrimination create new cases of statelessness. These occur when women are legally unable to convey their nationality to their children. This Article studies gender and birth status discrimination in nationality laws and in civil registration, family, and criminal law in each GCC state: Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, and the United Arab Emirates. Ending statelessness will require these states to end discrimination against women and non-marital children in all of its forms in law and practice.

Gcc Vat: The Intra-Gulf Trade Problem, Richard Thompson Ainsworth, Musaad Alwohaibi
Faculty Scholarship
It seems reasonably clear that by January 1, 2018 events will be set in motion for the adoption of a community-wide 5% value added tax (VAT) in the six Member States of the Gulf Cooperation Council (GCC).
The GCC’s Framework VAT document is expected to be published by the end of October 2016. One of the clearest, consistently placed observations is that the Arabian VATs will be destination-based and modeled on a European credit-invoice design. Intra-Gulf business-to-business (B2B) transactions will be effectively zero-rated by the supplier, and the buyer’s VAT will be directed to the destination jurisdiction. It is not …

Protection Of The Marine Environment Under International Law And Kuwaiti Criminal Law, Yousef H. Almutairi
Dissertations & Theses
The marine environment has unique characteristics that distinguish it from other elements of nature. Since seas and oceans cover more than two-thirds of the earth, they play a vital role in achieving biological and climatic balance on the planet. The marine environment also plays an important role in human life, since it has plenty of nutritious and industrial resources that directly affect human welfare. It also contains huge amounts of oil and natural gas, which has played a role in the economic prosperity of the world. Moreover, seas are considered a source of freshwater through resorting to desalination of seawater …

Collateral Damage: Protecting Cultural Heritage In Crimea And Eastern Ukraine, Zoe Niesel

Since the early spring of 2014, the world has watched Russia utilize military forces to invade and annex territory belonging to Ukraine. These actions are, unsurprisingly, raising concerns in Eastern Europe over the prospect of armed conflict in the region, the political consequences of Russian annexation of Ukrainian territory, and the effect of this conflict on ordinary civilians. But there is another potential cost associated with Russia's actions that should not be overlooked - the loss of Ukrainian cultural heritage. History is replete with examples of the destruction of cultural heritage during periods of instability, from Napoleon's systematic looting of …

The paper argues that the immediate effect of adopting this system is the restriction of …

Wwiv: Who We’Re Fighting- And Why, R. James Woolsey
Richmond Journal of Global Law & Business
We witnessed three global wars in the past century. Only a decade ago we ended WWIII, also known as the Cold War. But a new enemy has been on the march and we have entered a dangerous but subtler conflict: World War IV. This is not only a war against terrorism but also a war for democracy and for freedom. The enemy we fight includes Islamist Shi'sm, the Ba'athists in Iraq, and the Islamist Sunni terrorist networks. The dangers we face arise from the combination of rogue states, terrorist networks and availability of Weapons of Mass Destruction. Mr. Woolsey says …

The UN Compensation Commission Governing Council held Iraq liable for oil field damages in Kuwait, including damage caused by Allied bombing because a direct link existed between Iraqi conduct and the damage. The panel held that reasonable expenses can include extraordinary costs because Kuwait took reasonable steps in mitigating its expenses. Salaries to permanent Kuwaiti personnel are not a direct result of Iraq's conduct and cannot be reimbursed.
