Abortion rights and access are under siege in the United States. Even while current state-level attacks take on a newly aggressive scale and scope—emboldened by the United States Supreme Court’s June 2022 decision in Dobbs v. Jackson Women’s Health Organization to overturn Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey—the legal landscape emerging in the wake of Dobbs is decades in the making. Within the past year, individual plaintiffs and disability rights organizations have initiated a number of lawsuits against Uber, and similar companies like Lyft, alleging violations of Title III of the Americans with Disabilities Act of 1990 (Title III). In each of these cases, the plaintiffs’ success turns on affirmatively answering one significant threshold question: Whether Uber, or a similar entity, falls within the scope of Title III. Traditional taxi companies fall squarely within the Americans with Disabilities Act of 1990’s (ADA) coverage under 42 U.S.C. § 12184 (§ 12184), which governs private companies that provide transportation services. California Year In Review: 2013 Special Education Alj Decisions, Ruth Colker

Journal of the National Association of Administrative Law Judiciary

This article reviews 74 special education cases decided by California ALJs between January 1, 2013 and December 11, 2013. The author concludes that the ALJs provided stingy relief even when students prevailed, there was often unsuccessful litigation on behalf of a student following the termination of a consent decree or court order, many of the cases reflected negative attitudes towards the mothers of the student, and school districts often preferred more restrictive placements than the parent/student. Not surprisingly, students faced very unfavorable outcomes when they were not represented by a lawyer.

The California Disability Services Association (CDSA), an association of community-based nonprofit and for-profit organizations that provide assistance to people with intellectual and developmental disabilities, decided in 2013 that it was time to take a close-up look at the impact of the legislation 45 years after the act became law. It collaborated with the University of San Diego’s Caster Family Center for Nonprofit and Philanthropic Research (the Caster Center) to conduct a focus group study exploring perceptions of, and experiences with, disability services in California.

In America, plaintiffs in tort settlements receive more benefits, including Medicare benefits, than plaintiffs in worker's compensation cases. A properly established Medicare set-aside trust can guarantee that a disabled worker's Medicare benefits will be available after a worker's compensation settlement. This article discusses the theory behind a Medicare set-aside trust and tips for properly using it.

This Article analyzes the differing definitions of service animals under federal law as interpreted by three separate agencies. The regulations and case law interpreting the issue under the Americans with Disabilities Act, the Fair Housing Act, and the Air Carrier Access Act illustrate the need for further clarification in order to ensure that individuals with disabilities are granted the full protection of the law.

The Department of Justice (DOJ) is currently considering what standards should be applied to commercial web sites to make online information and services accessible to people with disabilities. Should the overall performance of a website be the measuring standard, or would compliance with technical rules be a sufficient measure of web accessibility?

There are dangers in adopting technical standards in DOJ regulations. The process of updating regulations is slow and will not keep pace with changing technology. Accessibility issues involving detailed technical standards would likely deteriorate into battles about computer programming techniques. Family members taking on the responsibility of caring for sick or disabled relatives is on the rise, and it is only trending upward in the future due to a multitude of factors. Illinois appeared to be on the edge of this trend by enacting the Statutory Custodial Claims statute for the Illinois Probate Act, which allows compensation for caregiving spouses, parents, siblings, and children; however, the language of this statute is ineffective in solving the problem it purports to set out to fix by creating very cumbersome, and rather unfounded, dedication and live-in requirements that are rarely met by the …
