Antitrust And International Regulatory Federalism, Andrew T. Guzman

Andrew T Guzman

In this Essay, Andrew Guzman proposes internationalization of antitrust law to supplant current methods of antitrust regulation across national borders. Specifically, instead of relying on local regulation, bilateral agreements between states, or a choice-of-law rule for antitrust enforcement, countries should adopt universal substantive standards. Moreover, Guzman recommends the World Trade Organization (WTO), which already employs a dispute resolution mechanism, as the governing forum for international antitrust issues. There, states can negotiate transfer payments in one international transaction to achieve agreement in another. Appendix 2 to Gary Munneke and Ann McNaughton's book about MDPs was the "Issue Checklist" that Professor Laurel Terry prepared for the ABA Commission on Multidisciplinary Practice (the ABA MDP Commission). This checklist identified the issues that Professor Terry believed the Commission should consider as it evaluated whether to amend ABA Model Rule of Professional Conduct 5.4 to permit MDPs.

Although this Issue Checklist was prepared in 1999, many of the issues it identifies remain relevant when considering issues related to alternative business structures (ABS) and alternative law practice structures (ALPS). It is relevant to the work of groups such …

This article addresses the effect in Germany of the globalization of legal services. The first section of the article consists of reflections about the development of the German legal market in the past decade and how this development has been influenced by Anglo-Saxon law firms from the U.S. and England. The second section of this paper provides a more detailed analysis of the legal framework that governs the practice of foreign lawyers in Germany will follow. INTRODUCTION: When I began teaching in 1981, I was assigned two separate Remedies courses to teach during the fall: Equitable Remedies and Legal and Extraordinary Remedies. For the Equitable course, I chose the text Leavell, Love & Nelson, Equitable Remedies, Restitution and Damages (3d ed. 1980) and for the Legal and Extraordinary course, York and Bauman, Remedies (3d ed. 1979). I was not sure what "extraordinary remedies" were if they were not equitable remedies, so I assumed they must be this topic called restitution. Religious Claims And The Dynamics Of Argument, M. Cathleen Kaveny

This Article investigates the questions whether and when religious claims may enter into public debate about important political issues by considering the purposes of argument in the public square. These purposes include: (1) argument as self-disclosure; (2) argument as persuasion; and (3) argument as bulwark against engagement with the ideas of others. The Article argues that restrictions on the use of religious claims in public deliberations and discussion impede the legitimate functions of public argument as self-disclosing and persuasive activities. Beyond The Polemic Against Junk Science: Navigating The Oceans That Divide Science And Law With Justice Breyer At The Helm, Joelle A. Moreno

The disjuncture between science and law became a significant practical, rather than theoretical, problem in 1993 when the Supreme Court decided Daubert v. Merrell Dow Pharmaceuticals, Inc. Daubert was a radical break from a tradition of judicial deference to scientific norms and conventions on questions of the admissibility of scientific evidence. The Court called upon the federal judiciary to slam the gate on all scientific evidence that is not "'scientific knowledge' . . . derived from the scientific method."' Since 1993, the Supreme Court has issued three opinions clarifying Daubert, and countless judges and legal commentators have wrestled with the …

Arbitration clauses now appear in many of the form contracts through which consumers obtain goods, services and credit. This article considers the effect on prices of two sorts of judicial decisions: (1) decisions making consumer arbitration clauses generally enforceable, and (2) decisions refusing to enforce arbitration clauses that lack certain pro-consumer features.

A forthcoming article, Christine Jolls, Accommodation Mandates, 53 Stan. L. Rev., provides a framework for analyzing the effects of employment discrimination statutes. This article extends that framework to employment arbitration to describe the effects of enforcement of employees' pre-dispute arbitration agreements. The article also critically reviews empirical studies of these effects.
