The Future Of Death Futures: Why Viatical Settlements Must Be Classified As Securities, Miriam R. Albert

Viatical settlements are a form of asset-backed security where a terminally-ill policyholder, known as a viator, sells the right to receive the proceeds of his or her life insurance policy to an investor. During his or her lifetime, the policyholder is paid an estimation of the present value of the death benefits under the policy. Viatical settlements are legal and serve a benevolent purpose. However, beyond the altruism of providing funds to the terminally ill, and the legalities of simply selling the right to receive life insurance proceeds to someone other than the insured, viatical settlements pose other legal and …

The 1998-99 NBA lockout, like the 1994 Major League Baseball strike, may have serious consequences for the future of the game. Already, the abbreviated training camps and compressed schedules have produced a spate of injuries and scores of ugly, low-scoring games. And the effects of the dispute on the game over the long run may be more difficult, if not impossible, to predict. But those questions are best left to those who track television ratings and ticket office receipts. In the United States, legislative responses to cloning among both federal and state lawmakers have been rapid and widespread. The Report of the NBAC to President Clinton proposed that Congress prohibit human cloning for a period of years. In the following year, Congress entertained a variety of bills proposing to ban or regulate human cloning. Some proposed prohibiting human cloning. Others proposed allowing such cloning for research purposes. Similarly, soon after Dolly's birth, state legislators presented a large number of bills aimed at regulating or prohibiting human cloning."
