The International Court of Justice ("ICJ" or "Court") is the successor to both the Permanent Court of Arbitration and the Permanent Court of International Justice. Before the first court was established in 1899, only ad hoc tribunals existed. This was due to a basic fact of international law that international tribunals possessed jurisdiction only if the parties to the case conferred it on the tribunal either for that case or previously by an international agreement. Therefore, the great problem of international law today is how to confer as much jurisdiction on the international court as possible. Now that the use …

It is common knowledge that the Treaty for the Prohibition of Nuclear Weapons in Latin America, the Treaty of Tlatelolco, prohibits reservations (Article 27), as does Additional Protocol 2 (Article 4). As for Protocol I, the fact that no mention is made of such a prohibition has been construed as meaning that such reservations are permissible.

A Commission of Inquiry on War Criminals, headed by Mr. Justice Jules Deschenes, was established by the Federal Government on 7 February 1985 to determine whether or not alleged Nazi war criminals were resident in Canada and to recommend legal measures to ensure that such war criminals are brought to justice. Increasing populations and industrial and agricultural development worldwide are placing much greater demands on groundwater supplies. Many of these groundwater basins or aquifers underlie two or more countries and are, thus, international or transboundary. Withdrawals from one country can drain life-giving water from a neighboring country and, as a consequence, be the source of severe and protracted conflict. Unfortunately, international law and treaty practice are only at a beginning stage. With the goal of advancing international law and institutions on the matter, a multi-disciplinary group of specialists over an eight-year period have developed a draft international groundwater treaty.
