Terrorism As An International Crime: Questions Of Responsibility And Complicity, Sompong Sucharitkul

Terrorism is a phenomenon in the contemporary world which occupies the attention of the international community. Terrorism as an international crime is readily more comprehensible and susceptible of clearer definition than sheer acts of terrorism by whomsoever performed. This paper is confined to questions of responsibility and complicity in connection with terrorism as an international crime, whatever the definition is ultimately adopted of "terrorism," and whatever the meaning to be ascribed to an "international crime."

Public international law, through its rules regulating the dealings between independent nations, purports to impose limits on the actions of all governments, including those of the United States. In this context American lawyers interested in foreign relations may reasonably wonder whether American courts would enforce rules of public international law purporting to bind the United States against the United States government, particularly the executive branch. A fair number of Supreme Court cases have dealt with the enforce ability of treaties in American courts.' Treaties, however, are only one source of international law. When the international community first became interested in the problem of human rights during the second world war and then enunciated those rights in a series of international instruments, there was a tendency among writers to deal with the issue as a comprehensive whole. Professor Anand over the past two-and-a-half decades has established himself as one of the leading Third World publicists of international law. Less rhetorical than some, but just as vigorous, he has championed the development of a new international law based on cooperation in rejection of the old traditional and "Eurocentric" international law. In International Law and the Developing Countries Professor Anand brings together a collection of his previously published essays and wields them into a book for the purpose of evaluating "the traditional law and the process of change that it is undergoing to become a communal law of mankind".

Maximilien Bibaud was a most unusual man: student of philosophy, history, and literature, teacher, author, chronicler and reformer of the law, founder of the first organized law school in Canada, true pioneer of the teaching of international law in this country. Insolently but exhilaratingly new in both his ideas and his techniques for legal education, Bibaud was far in advance of his time. As we mark the centenary of his death in 1987, his interests and achievements are as relevant today as they were when he opened his law school 136 years ago.

Costa Rica's permanent neutrality was proclaimed on November 17, 1983. Costa Rica is the only Latin American State with a legal regime of permanent neutrality, as well as the single Member State of the Organization of American States which is also a Party to the Inter- American Treaty for Reciprocal Assistance (Rio de Janeiro, 1947), which has adopted permanent neutrality as a guiding principle of its foreign policy.
