Chilling Effects: Online Surveillance And Wikipedia Use, Jonathon Penney

This article discusses the results of the first empirical study providing evidence of regulatory “chilling effects” of Wikipedia users associated with online government surveillance. The study explores how traffic to Wikipedia articles on topics that raise privacy concerns for Wikipedia users decreased after the widespread publicity about NSA/PRISM surveillance revelations in June 2013. Using an interdisciplinary research design, the study tests the hypothesis, based on chilling effects theory, that traffic to privacy-sensitive Wikipedia articles reduced after the mass surveillance revelations. On a Friday in 2005, the Los Angeles Times launched an experiment: a “wikitorial” on the Iraq War that any of the paper’s readers could edit. By Sunday, the experiment had ended in abject failure: vandals overran it with crude profanity and graphic pornography. The wikitorial took its inspiration and its technology from Wikipedia, but missed something essential about how the “the free encyclopedia that anyone can edit” staves off abuse while maintaining its core commitment to open participation.

Wikipedia has quickly become the largest volume of collected knowledge on the planet, but it is also one of the busiest centers for dispute resolution in the world. This Essay explains why Wikipedia will not be able to maintain a credible website while simultaneously letting anyone freely edit it. To date, Wikipedia editors have successfully defended against malicious attacks from spammers and vandals, but as editors turn over, Wikipedia will need to recruit replacements. However, Wikipedia will have difficulty with this recruiting task due to its limited incentives for participation. Faced with a potential labor squeeze, Wikipedia will choose to restrict users’ ability to contribute to the site as a way of preserving site credibility. This short essay surveys the state of open access to primary legal source materials (statutes, judicial opinions and the like) and legal scholarship. The ongoing digitization phenomenon (illustrated, although by no means typified, by massive scanning endeavors such as the Google Books project and the Library of Congress's efforts to digitize United States historical documents) has made a wealth of information, including legal information, freely available online, and a number of open-access collections of legal source materials have been created. Many of these collections, however, suffer from similar flaws: they devote too much effort to collecting case law rather than …

The beginning of the fall 2009 semester marks another benchmark in the physical transformation of the Notre Dame Law School facility. This will be the only complete academic year without dedicated library study and research space and with just one-quarter of our print collection onsite. For first year students, this will mark some changes in the way that we teach legal research.
