Founded in January 2016, the Wilbanks Child Endangerment and Sexual Exploitation Clinic (the CEASE Clinic) represents survivors of child sexual abuse in juvenile court dependency matters and civil litigation and is the first of its kind in the nation. The CEASE Clinic was established through a generous donation by Georgia Law alumnus Marlan Wilbanks (JD ‘84) in response to a new Georgia law known as the Hidden Predator Act (the HPA) that went into effect on July 1, 2015. The HPA extended the statute of limitations for civil claims arising out of acts of child sexual abuse by providing a …

I am thrilled that the editors of the Boston University Law Review have chosen to review Anthea Roberts’ recent book, Is International Law International?, for their annual symposium. In order to answer the title’s question, Roberts develops a research project to scrutinize a world she knows well: the field of teaching international law, her colleagues, and their students. The result is a rigorous disaggregation of the multifarious ways that international law is taught across the globe, thus demonstrating the lack of universality in the study of international law.

There are consistent messages to people of color about their proper place in
society, which has always been a really important tool for maintaining and
advancing white supremacy. Referring back to what Professor Haney-Lopez
asserted earlier today, in today’s post-civil rights society, few people would
argue in favor of segregation in racial terms explicitly so. And few people would
assert that Blacks, for example, do not belong in certain places. However,
opponents of affirmative action have begun to articulate a form of these
arguments as an add-on to the mismatch theory. In the minds of these scholars,

Teaching Voluntary Codes And Standards To Law Students, Cary Coglianese, Caroline Raschbaum

Voluntary codes and standards issued by nongovernmental institutions affect many aspects of legal work and daily life. Although these codes and standards are voluntary—that is, they are not directly enforceable through civil or criminal penalties—they can and do often shape behavior. Codes and standards inform business practices and product designs. They affect the provisions of contracts and the licensing of patents. And, among still other uses, they affect the handling of evidence in criminal law matters.
More broadly, voluntary codes and standards can play a role similar to, or even take the place of, government regulations. Regulators regularly defer to …

For lawyers, learning law by practicing law is customary. In the world of legal education, learning from practice is situated in both acceptance and opposition. There are practical arguments in its favor—the practicing bar wants law graduates to be “practice ready,” and theoretical arguments—understanding how law operates in the real world yields a clearer understanding of law itself, how it maintains social and economic structures, and how it impacts individuals. This Article posits that the University of Georgia School of Law for Clinical Programs course syllabi demonstrate implementation of recommendations found in leading works that advocate for change in traditional legal education. This Article reviews some high points of legal education reform with a focus on clinical legal education and then discusses the role of syllabi in the classroom and the potential within the document that many professors miss. This Article then turns to using syllabi to measure the extent that the clinics are implementing instruction that addresses all three apprenticeships as defined in the Carnegie Report.. This conversation, conducted over three evenings, captures some of our thoughts about the last half century of legal education as both of us near retirement. In an externship setting, where students are asked to combine theory and practice, intentional reflection is key to processing what has been learned from experience. Students are asked to maintain an open curiosity about practice and to connect with their inner experiential world as part of this process. There is a natural connection between reflection and contemplative practice. Teaching reflection to law students can be enhanced by introducing mindfulness practices which share similar attributes such as open awareness, observation, and acceptance of both positive and negative outcomes. Clinicians, unlike their peers in the legal academy, are embedded in their clients’ experiences of the legal system. Because of their location in the academy, “they have the potential to transform the study of law into the study of a culture that deploys law for various purposes,” in the words of Phyllis Goldfarb. In this short essay, we highlight a thread of clinical scholarship which we identify as growing from clinicians’ unique and embedded stance. We seek to convince, using a few examples of clinical scholarship, that our collective critical stance has yielded, over the last several decades, a growing …
