The Jury's Political Role: "To See With Their Own Eyes", Valerie P. Hans

Under what circumstances, if any, is it right for juries to ignore the dictates of law in arriving at their verdicts? The political role of the jury has come into the spotlight recently. Legal scholars have labeled as "jury nullification" the refusal of juries to apply the law when they believe that to follow the letter of the law would result in injustice. Jury nullification is actually a form of jury equity, the practice of deciding cases in line with community notions of justice and fairness.

The Place Of Procedural Control In Determining Who May Sue Or Be Sued: Lessons In Statutory Interpretation From Civil Rico And Sedima, Douglas E. Abrams

When a federal court resolves equipoise in its effort to determine the contours of a litigant class created by an express private cause of action, the court should consider the control that the Federal Rules of Civil Procedure, taken as a whole, exercise on the conduct of litigation. With civil RICO as background, part II presents this thesis and discusses the circumstances in which procedural control would be an element supporting a determination *1481 that Congress created a broad litigant class. The traditional view of the first amendment's free speech guarantee as absolute, allowing few and narrow exceptions, reflects the Constitution's dedication to an open and unfettered exchange of ideas. Those thoughts that are abhorrent to a free society, the argument goes, will wither when aired but fester if suppressed. Moreover, who is to decide which ideas are offensive? The interests of the state may well be inferior to those of the people, the wisdom of public servants often suspect in quality and motivation. A House Of Lords' Judgment, And Other Tales Of The Absurd, Alan Watson

In this paper I want to look at four approaches to deciding a case in different societies-contemporary England, uncodified civil or 'mixed' law systems (with an example from 17th century Scot-land and another from early 20th century South Africa), 19th century France after codification, 15th century Germany with a glance at 13th and 14th century Spain-where the attempt is made each time to reach the correct decision by applying the mental process thought most appropriate. None of the approaches examined here is result-oriented, and to outsiders, especially to lawyers brought up in a different legal culture, the mental process seems …

Anthropological Report On Land Use: Pueblo Of Sandia, Elizabeth A. Brandt
Sandia Pueblo Mountain Claim
Sandia Pueblo is an Indian community located approximaaiy 13 miles north of Albuquerque, New Mexico on the east bank of the Rio Grande river, a few miles to the west of the Sandia Mountains. Archaeological evidence shows that the village site was occupied around 1300 A.D. and that the village has remained in essentially the same area since then. The surrounding area was occupied by Indian hunters as early as 11,000 years ago and there is evidence of numerous smaller sites around Sandia and in the foothills of the mountain dating in the last millenia.
