The Multi-Stakeholder Forum, held on 28 May 2013, was jointly organized by the ASEAN CSR Network, Singapore Compact, the Asian Peace-building and Rule of Law Programme of the Singapore Management University’s School of Law ("SMU-APRL"). From Aversion To Acceptance: Evolution Of The Asean Human Rights Agenda, Siraj Aziz Shaik

This paper examines the evolution of ASEAN’s attitude towards human rights from one of aversion on the premise of cultural relativism to the acceptance of its universality as demonstrated by the adoption of the ASEAN Human Rights Declaration. In doing so, it also examines the veracity of cultural relativist objection to universality of human rights. The paper then examines the obstacles that militate against ensuring institutionalisation on the ground via the rule of law.

Expecting The Right Thing: The Imperative For Recognising Substantive Legitimate Expectations In Singapore, Siraj Aziz Shaik, Yi Siong Sui

Recognition of a legitimate expectation for a substantive benefit has long been fraught with controversy both within jurisdictions that do and do not adopt the doctrine. This article seeks to assess the validity and utility of the doctrine of substantive legitimate expectations as it has developed in common law jurisdictions and extrapolate a conclusion which would be of guidance as to what the Singapore position on the doctrine ought to be. This article argues that on balance the doctrine of substantive legitimate expectations is a welcome addition to the landscape of administrative law in Singapore, and that the seminal case …

Singapore aspires to retain its place as a trusted arbitration hub for commercial parties all around the world. The recently proposed amendments to the International Arbitration Act seek to bring Singapore closer to meeting international standards in relation to the arbitration procedure. While the initiative should be applauded, those amendments relating to interim measures fall somewhat short of expectations of a new, broader framework of curial assistance in aid of arbitration. Reconstituting The “Un-Person”: The Khmer Krom &The Khmer Rouge Tribunal, Mahdev Mohan

Despite the grand promise of victim participation at the ongoing trials of Extraordinary Chambers in the Courts of Cambodia (“ECCC”), this article notes the plight of an undeserved ethnic community, the members of which have become forgotten victims of genocide. The Article argues that if the ECCC’s trials are to have any resonance for the Khmer Krom, its affiliates and victims’ lawyers should avoid “othering” Khmer Krom victims of genocide, and instead adopt ethnographic approaches to lawyering that seek to ascertain communal desires for vindication.
