Scholarship On Soviet Family Law In Perspective, Whitmore Gray Jan 1970

Scholarship On Soviet Family Law In Perspective, Whitmore Gray

Articles

The radical changes in the norms of Soviet family law over the past fifty years have reflected the convulsions of Soviet society as well as the revisions of Marxism-Leninism-Stalinism. This paper is a commentary on the writing in this field by Americans in particular, and by other non-Soviets in general. In view of the volume of writing in this field, it has been necessary to limit discussion in the text to a few representative articles illustrating a few of the subject matters treated and various typical approaches employed. The topic is a particularly timely one, for new, comprehensive Principles of …

Don't Speak Of Love, John W. Reed Jan 1970

Don't Speak Of Love, John W. Reed

Other Publications

I was asked to speak to you this morning about communication in the courtroom. Specifically I was told that this group, keenly interested in the trial process, would like to hear any comments I might offer on problems of persuading judges and jurors. If your delegate who invited me misread your interest, you still have time to move to the Lewis and CLark Room, down the hall, where, indeed, some of the most able communicators in the trial business are demonstrating what I shall only describe.

The Anatomy Of A Clinical Law Course, James J. White Jan 1970

The Anatomy Of A Clinical Law Course, James J. White

Other Publications

Since the summer of 1965 when the Michigan Supreme Court first authorized law student practice on the behalf of indigent persons, students at the University of Michigan Law School have been engaged in extensive practice on behalf of indigent persons in Washtenaw County. Between 75 and 125 second and third year students at the University of Michigan Law School each semester have worked at the Washtenaw County Legal Aid Clinic under the direction of the OEO Staff attorneys. Students receive neither credit nor pay for such work and their activities are not directly supervised by the faculty. That volunteer experience …

When The Cops Were Not 'Handcuffed', Yale Kamisar Jan 1970

When The Cops Were Not 'Handcuffed', Yale Kamisar

Book Chapters

Are we losing the war against crime? Is the public getting a fair break? Has the pendulum swung too far to the left? Do the victims of crime have some rights, too? Are the courts handcuffing the police?

If there were a hit parade for newspaper and magazine articles, speeches and panel discussions, these questions would rank high on the list. Not only are they being raised with increasing frequency, but they are being debated with growing fury.

Last year, probably the most famous police chief in the United States, William H. Parker of Los Angeles, protested that American police …

Federal Grants And The Reform Of State And Local Government, Terrance Sandalow Jan 1970

Federal Grants And The Reform Of State And Local Government, Terrance Sandalow

Book Chapters

Increasingly in recent years, discussion of the appropriate division of responsibilities between the nation and the states has shifted from ideological to pragmatic grounds. One consequence of that shift has been to bring into sharper focus the dilemma which confronts the growing number of those who believe that the existing structure of government is inadequate to the pressing tasks which face the nation, especially those tasks which center upon the metropolitan areas now inhabited by two-thirds of the nation's population. A rapidly developing consensus among persons of widely divergent political perspectives accepts the view summed up in Walter Heller's (1966: …

An Introduction To Riot Legislation, Jerold H. Israel Jan 1970

An Introduction To Riot Legislation, Jerold H. Israel

Book Chapters

My speech will provide an introduction to criminal code legislation specifically pertaining to riots and a brief description of our recent experience with riots. Hopefully, this description, supplemented by the film on the Detroit riot, will provide an appropriate factual background for both the remainder of my own talk and the analyses of proper police procedures during riots (and other civil disorders) to be presented by Major Brown and Professor Martin.

Jefferson B. Fordham: His Contribution To Local Government Law, Terrance Sandalow Jan 1970

Jefferson B. Fordham: His Contribution To Local Government Law, Terrance Sandalow

Articles

The study of local government has not, by and large, attracted and held the interest of the ablest minds in the legal profession. Much of the same has been true within economics and political science, the social sciences from which lawyers might have anticipated most assistance in designing legal institutions to cope with the problems of an urban nation. Lawyers who have come to the area during the past decade have not, in consequence, had the advantages of a strong intellectual tradition upon which to build in the effort to understand and to come to grips with current problems.

The Virtues Of Nonsimulation Games, Layman E. Allen, Robert W. Allen, Joan Ross Jan 1970

The Virtues Of Nonsimulation Games, Layman E. Allen, Robert W. Allen, Joan Ross

Articles

The use of games as teaching devices is receiving attention from an increasing number of educators. Data from tests conducted with one such educational game-WFF ’N PROOF strongly indicate that this and similar games are useful, not only in teaching a particular subject (in this case symbolic logic), but also in increasing the general problem-solving ability of the student. WFF ’N PROOF is actually not one game but a series of 21 games of increasing difficulty. The first games in the series are quite simple and can be enjoyed by first graders. The final games are challenging and stimulating even …

Transactions Subject To The Federal Gift Tax, Douglas A. Kahn Jan 1970

Transactions Subject To The Federal Gift Tax, Douglas A. Kahn

Articles

The federal gift tax was first enacted in 1924, approximately eight years after the adoption of the estate tax. As originally enacted, the tax was largely ineffective because it was computed on an annual basis without regard to gifts made in prior years.

Enforcement Of A Promise In Modern American Law (Gendai Amerikaho Ni Okeru Yakusoku No Kyosei), Whitmore Gray

The sixth and final installment describes the history of contractual enforcement in the U.S. and highlights changes introduced through adoption of the UCC.

Representing The Low Income Consumer In Repossessions, Resales And Deficiency Judgment Cases, James J. White Jan 1970

Representing The Low Income Consumer In Repossessions, Resales And Deficiency Judgment Cases, James J. White

Articles

The goal of this article is to lend a helping hand to the debtor's lawyer in his job of defending deficiency judgment suits brought following the repossession and resale of a debtor's encumbered personal property. Although some of the following discussion is relevant to the defense of any creditor's suit, and some applies to representation of the debtor prior to repossession or resale, the focal point of the discussion is the low-income consumer who has lost his automobile, television or some other "hard good" and has become a defendant in a suit brought by his secured creditor for a deficiency …

Mandatory Buy-Out Agreements For Stock Of Closely Held Corporations, Douglas A. Kahn Nov 1969

Mandatory Buy-Out Agreements For Stock Of Closely Held Corporations, Douglas A. Kahn

Articles

A buy-out of a shareholder's stock is a sale of his stock holdings in a specific corporation pursuatnt to a pre-existing contract. In recent years such arrangements have, deservedly, become an increasingly popular planning device for shareholders in closely held corporations; they make it possible to limit the class of potential shareholders, provide liquidity for the estate of a deceased shareholder, and establish a value for stock which has no active market. There are two popular categories of buy-out plans. If the prospective purchaser of a decedent's shares is the corporation that issued them, the plan is called an "entity …
