Three years ago France adopted rules to regulate the practice of foreign
lawyers, and last year New York State adopted rules for the licensing of legal

While the courts and the government grapple with the concepts and consequences of access, activist citizens press broadcasters to open the airwaves. In the resulting legal tangle, the effective means of securing access are essentially extralegal, while the legal means are essentially ineffective.

Comparative Broadcast Licensing Procedures And The Role Of Law: A Fuller Investigation, Michael Botein

Professor Botein examines the validity of Professor Fullers widely read but seldom criticized theory that traditional administrative adjudication is unsuited to resolve certain kinds of social task, which Fuller has labeled "polycentric problems." Professor Botein focuses upon Professor Fuller's example of the FCC's comparative licensing procedure as a poblem unsuited to adjudication. The Refuse Act of 1899, although approaching its diamond anniversary, is alive and well and providing the best legal framework for cleaning up the nation's navigable streams and their tributaries. Its absolute standard of no pollution, which is ameliorated through practical application, is to be preferred over attempts to provide elaborate statutory standards.

The Constitutionality Of Restrictions On Poverty Law Firms: A New York Case Study., Michael Botein

Government-funded poverty law firms are presently providing essential legal services to poor people throughout the country. These firms have met with varying responses from the bar and the courts. In this article, Professor Botein examines the response of New York's Appellate Division, First Department-a comprehensive set of regulations governing the practice of law by poverty law firms. After analyzing these regulations and the constitutional issues they raise, the author concludes that both procedurally and substantively there is strong doubt concerning their validity.

Cafeteria Workers Revisited: Does The Commander Have Plenary Power To Control Access To His Base?, Jethro K. Lieberman

The Supreme Court's decision in Cafeteria Workers v. McElroy (1961) has often been cited by military commanders to support claimed plenary power over access to the installation commanded. Observing that plenary power is a rarity in contemporary society, Lieutenant Lieberman questions the prof erred interpretation of Cafeteria Workers particularly in light of more recent decisions. He concludes that while commanders do possess broad powers over access, the power is not plenary but must be weighed in each instance against the individual's rights of freedom of speech and association.

Catv Regulation: A Jumble Of Jurisdictions, Michael Botein

The community antenna television (CATV) industry is rapidly becoming a major element of the communications media. Unfortunately, attempts to regulate the industry have not kept pace. Local, state and federal authorities were slow to recognize the need for CATV regulation and, when they finally entered the field, their efforts were uncoordinated and inadequate. But, recent activity in the field by city and state authorities, the Federal Communications Commission and the Congress signals the emergence of a multi-jurisdictional system of CATV regulation. The author describes this system and suggests improvements that will encourage CATV to realize its full potential.
