Principles Of Internet Privacy, Fred H. Cate

Articles by Maurer Faculty

The definition of privacy developed by Brandeis and Warren and Prosser, and effectively codified by Alan Westin in 1967 - the claim of individuals, groups, or institutions to determine for themselves when, how, and to what extent information about them is communicated to others - worked well in a world in which most privacy concerns involved physical intrusions (usually by the government) or public disclosures (usually by the media), which, by their very nature, were comparatively rare and usually discovered.

But that definition's exclusive focus on individual control has grown incomplete in a world in which most privacy concerns involve …

Secular Fundamentalism, Religious Fundamentalism, And The Search For Truth In Contemporary America, Daniel O. Conkle Jan 1996

Secular Fundamentalism, Religious Fundamentalism, And The Search For Truth In Contemporary America, Daniel O. Conkle

Articles by Maurer Faculty

In this article, I suggest that America's ongoing culture war is a product, in part, of an epistemic crisis that confounds our collective search for truth. In a previous article addressing aspects of this topic, I expressed concerns about religious fundamentalism. Here, I explore the ways in which secular thinking might likewise be described as "fundamentalist." In particular, I discuss secular fundamentalism in textual interpretation, secular fundamentalism in the form of political liberalism, and comprehensive secular fundamentalism, which extends to private questions of truth. I then discuss the various problems - not only political, but also theological - that are …

A Married Woman's Surname: Is Custom Law?, Julia C. Lamber Jan 1973

A Married Woman's Surname: Is Custom Law?, Julia C. Lamber

Articles by Maurer Faculty

A general awakening of concern for the rights of women has occurred in recent years, and with it the particular problems of married women have been analyzed against a background of centuries of legal and social assumptions. With the impetus of employment discrimination legislation, the proposed equal rights amendment, and litigation raising sex discrimination issues, it is not surprising that many women are actively seeking to retain their pre-marriage names. This movement compels us to re-examine the custom that a woman must assume her husband's surname upon marriage. That such a phenomenon is custom and not law deserves our attention …

Press Release: October 22, 1957, Lectures And Honorary Degrees To Precede New Law Building Dedication, Indiana University News Bureau

Law School Building

BLOOMINGTON, Ind. -- Lectures on three phases of law -- practice, judicial interpretation, and teaching -- will provide a two-day program preceding the dedication Nov. 2 of the new law school building at Indiana University.

The University, it was announced Monday by Dean Leon H. Wallace, will confer honorary doctor of laws degrees at the convocation on Chief Justice Warren, Herman C. Krannert, board chairman of Inland …

Letter From Luther M. Grimes, Class Of 1893 (1957), Luther M. Grimes Oct 1957

Letter From Luther M. Grimes, Class Of 1893 (1957), Luther M. Grimes

Law School Building

Upon receiving an invitation to attend the 1957 dedication festivities for the newly built law building, Class of 1893 alum Luther M. Grimes hand wrote a response that is one part RSVP and one part trip down memory lane.

He said that he was regretfully unable to attend; at 87 1/2 years it was "on account of age" that he couldn't travel from his Iowa home. He considered that he may have been among the oldest living Indiana University alums, and was, with certainty, the last surviving member of his law class.

As a Bloomington native with familial ties to …
