Global Justice And International Economic Law: Three Takes, Frank Garcia Dec 2012

Global Justice And International Economic Law: Three Takes, Frank Garcia

Frank J. Garcia

For centuries, international trade has been seen as essential to the wealth and power of nations, and defended as a system through which all could benefit. It is only recently that trade's problematic role as an engine of distributive justice has begun to be understood, due in part to globalization and the global justice debates. In this compelling new book, international legal scholar Frank J. Garcia proposes a radically new way to evaluate, construct, and manage international trade - one that is based on norms of economic justice as well as comparative advantage and national interest. This book examines three …

Normative Patterns And Legal Developments In The Social Dimension Of The Eu, Ann Numhauser-Henning, Mia Rönnmar Dec 2012

Normative Patterns And Legal Developments In The Social Dimension Of The Eu, Ann Numhauser-Henning, Mia Rönnmar

Ann Numhauser-Henning

This book explores the normative and legal evolution of the Social Dimension of the EU - labour law, social security law and family law - in both the EU and its Member States, during the last decade. It does this from a wide range of theoretical and legal-substantive perspectives. The past decade has witnessed the entering into force of the Lisbon Treaty and its emphasis on fundamental rights, a new coordination regulation within the field of social security (Regulation 883/2004/EC), and the case law of the Court of Justice of the European Union in the so-called Laval Quartet. Furthermore structural …

Contro Riforme (In Italian), Ugo Mattei Dec 2012

Contro Riforme (In Italian), Ugo Mattei

Ugo Mattei

The Cambridge Companion To Comparative Law / Edited By Mauro Bussani And Ugo Mattei, Ugo Mattei, Mauro Bussani

Ugo Mattei

We can only claim to understand another legal system when we know the context surrounding the positive law in which lawyers are trained. To avoid ethnocentricity and superficiality, we must go beyond judicial decisions, doctrinal writings and the black-letter law of codes and statutes and probe the 'deeper structures' where law meets cultural, political, socio-economic factors. It is only when we acquire such awareness and knowledge of the critical factors affecting both the backgrounds and implications of rules that it becomes possible to control the present and possibly future developments of the world's legal institutions. This collection of essays aims …

Contracting Law, Deborah Post, Amy Kastely, Nancy Ota, Sharon Hom

Deborah W. Post

Revised and updated to 2006, the fourth edition of Contracting Law continues the clear explanations of contract doctrine, engaging cases, and thought-provoking cultural and historical materials that have made this casebook a favorite of students and professors. Students and faculty appreciate the fact that no separate statutory supplement is necessary. Selected provisions from the Restatement Second of Contracts and the Uniform Commercial Code are included in the casebook as appendices. The workbook (purchased separately), complete with flow charts, vocabulary lists, problems and structured exercises, helps students understand legal doctrines, case briefing, and synthesis. Students can use the workbook independently or …

Tribes, Land, And The Environment, Sarah Krakoff, Ezra Rosser Jan 2012

Tribes, Land, And The Environment, Sarah Krakoff, Ezra Rosser

Ezra Rosser

Legal and environmental concerns related to Indian law and tribal lands remain an understudied branch of both indigenous law and environmental law. Native American tribes have a far more complex relationship with the environment than is captured by the stereotype of Indians as environmental stewards. Meaningful tribal sovereignty requires that non-Indians recognize the right of Indians to determine their own relationship to the land and the environment. But tribes do not exist in a vacuum: in fact they are deeply affected by off-reservation activities and, similarly, tribal choices often have effects on nearby communities. This book brings together diverse essays …

Beni Comuni - Un Manifesto (In Italian), Ugo Mattei Dec 2010

Beni Comuni - Un Manifesto (In Italian), Ugo Mattei

Ugo Mattei

Fifteen Years With The Norma Research Programme, Ann Numhauser-Henning Dec 2009

Fifteen Years With The Norma Research Programme, Ann Numhauser-Henning

Ann Numhauser-Henning

The Norma Research Programme started out fifteen years ago – in 1996 – at the Law Faculty of Lund University with funding from the Bank of Sweden Tercentenary Foundation. The programme was initiated by me and my former colleague Professor Anna Christensen, who sadly passed away in March 2001. Norma is short for ‘Normative Development within the Social Dimension, Studies on the Normative Patterns and Their Development in the Legal Regulation of Employment, Housing, Family and Social Security from a European Integration Perspective’. The purpose of the programme was to create a research environment where basic normative patterns and their …

Schlesinger's Comparative Law, 7th Ed., Ugo Mattei, Teemu Ruskola, Antonio Gidi

Ugo Mattei

This book enlarges the perspective of comparative law to include the experiences of the non-Western world, which increasingly occupies the center stage in a global approach to the law. Accordingly, the book incorporates diverse legal materials from Asia, Africa, and Latin America. In addition, it includes a greatly enhanced methodological discussion that brings the book up-to-date with the latest debates in the field.

Commercial Trusts In European Private Law, Ugo Mattei, Lionel D. Smith, Michele Graziadei Jun 2005

Commercial Trusts In European Private Law, Ugo Mattei, Lionel D. Smith, Michele Graziadei

Ugo Mattei

In European legal systems, a variety of approaches to trust and relationships of trust meet the universal professionalisation of asset management services. This book explores that interface in order to seek a better understanding of the legal regulation of the entrustment of wealth. Within the methodology of the Common Core of European Private Law, the book sets out cases on the establishment and termination of management relationships, obligations of loyalty and of professionalism, and the choice of law. More specialized cases address collective investment, collective secured lending, pension funds, and securitisation. Reports on these cases from fifteen jurisdictions of the …
