Turning Over Stones: Advocating For Stronger Reporting Requirements For Opportunity Zones, Blake Stocke

In 2017, Congress passed Sections 1400Z-1 and 1400Z-2 into the Internal Revenue Code, effectively codifying new tax legislation dubbed ‘Opportunity Zones.’ This legislation, which received bipartisan support, was meant to provide investors with a tax break to incentivize investment in low-income communities. The Opportunity Zone program is a substantial tax expenditure for Congress, and one that proponents believe can attract investment into parts of the United States suffering from diminutive economic growth. However, critics doubt this program will benefit those living in distressed communities, and fear that Opportunity Zones will instead promote gentrification while giving wealthy investors unnecessary tax breaks. …

From Crisis Springs Opportunity: Using Virtual Learning To Develop More Effective Lawyers, Anita M. Singh

The increase in virtual, distance, and remote learning necessitated by the COVID-19 pandemic has presented new challenges to law school faculty and students. But at the same time, increased virtual interactions provide us with a unique opportunity. In particular, increased virtual interactions allow us to test and stress students’ “virtual intelligence,” a suite of more intangible skills that also promotes lawyer effectiveness. These skills include traditional project management tasks and conventional social engagement, but on a heightened level given the challenges inherent in virtual interactions. Title IX fails to provide the tools or guidelines necessary to equalize opportunities for all student athletes in the collegiate setting despite the government’s continuous effort to explain the law. This failure is because judicial precedent has largely developed around the binary proportionality test of compliance. Title IX was originally intended to equalize educational opportunities for male and female students in order to remedy past discrimination in our society. Over especially the last 50 to 60 years, US laws and policies concerning the sexual relationships between men and women have more consciously articulated a need to pursue social justice according to the categories of autonomy, equality, diversity and care for the poor. These categories are admirable on their face and responsive to the times in which they emerged. They are particularly well-suited to the history of discrimination against women and African Americans in the US. In an era where immigration and asylum is at the forefront of many western nationals’ minds, so too should be the reasons behind an individual’s intent to seek refuge in a new country. The Impact Of Low Self-Control On Online Harassment: Interaction With Opportunity., Hyunin Baek, Michael M. Losavio, George E. Higgins
Journal of Digital Forensics, Security and Law
Developing Internet technology has increased the rates of youth online harassment. This study examines online harassment from adolescents with low self-control and the moderating effect of opportunity. The data used in this study were collected by the Korea Institute of Criminology in 2009. The total sample size was 1,091. The results indicated that low self-control, opportunity, and gender have a significant influence on online harassment. However, these results differed according to gender; for males, low self-control significantly impacted online harassment; for females, however, only low self-control significantly impacted online harassment. How Opting Out Among Women With Elite Education Contributes To Social Inequality, Joni Hersch

This paper, written for the 2013−2014 Symposium of the Indiana Journal of Law and Social Equality, expands on my research showing that women who are graduates of elite institutions have lower labor market activity than their counterparts who are graduates of non-selective institutions. I provide new statistics on the relation between status of undergraduate institution and family background, likelihood of earning a professional or graduate degree, earnings, and trends in opting out. These data show that the gap in labor market activity on the basis of educational status was largely unchanged between 2003 and 2010 and that graduation from an …

Leveraging Tribal Sovereignty For Economic Opportunity: A Strategic Negotiations Perspective, Gavin Clarkson, Jim Sebenius

Part II of this Article discusses the sovereign nature of tribal governments and reviews the history of tribal sovereignty, concluding with an examination of tribal-state compacting outside of the gaming context. Part III examines the origins of Indian gaming, focusing on the development of the legal framework which governs tribal gaming activities and necessitates the negotiation of tribal-state gaming compacts. Given the need for tribal-state negotiations, Part IV presents a framework for structuring and analyzing negotiations. Part V applies that framework in the retelling of the first part of the Foxwoods story, the negotiations regarding the original gaming compact. The …

Congress passed the Private Securities Litigation Reform Act of 1995 ("PSLRA") to prevent frivolous lawsuits that had been draining resources from businesses. This legislation included provisions for heightening the pleading requirements for the scienter, or state of mind, requirement for securities law violations. Many circuit courts debated whether the motive and opportunity test for scienter, applied initially by the Second and Third Circuits, survived the passage of the PSLRA. This Note argues that while the motive and opportunity test has been discounted by numerous circuits, it not only remains viable for pleading scienter under the PSLRA, but it accomplishes the …

Sangaré, a poor young farmer from a village in southern Mali, leaves his wife and three children to find stable employment in the capital city of Bamako. What he finds is an unrewarding reality that leads him from small job to small job, only earning about US 22 cents per day. These jobs range from selling sunglasses, to shining shoes, to driving a rickshaw. Unfortunately, his income has not proved enough to provide for his family, as his aunt has since adopted his daughter, and his children cannot attend school.
