It Happens In The Dark: Examining Current Obstacles To Identifying And Rehabilitating Child Sex- Trafficking Victims In India And The United States, Emily K. Harlan

University of Colorado Law Review

The governments of India and the United States have been struggling for years to eradicate child sex trafficking within their borders. Nevertheless, many Indian and American child sex-trafficking victims have yet to be identified as victims or provided with rehabilitation services. Both countries need to make additional legal and policy reforms to ensure their legal systems correctly identify child sextrafficking victims and provide them with meaningful opportunities for rehabilitation. This Note identifies police corruption in India and the disparate treatment of foreign and domestic victims in the United States as the major obstacles to correctly identifying child sex-trafficking victims, and …

Sustainable Development And The Reconciliation Of Opposites, Alison Peck

Saint Louis University Law Journal

This Essay proposes a shift in thinking about the project of sustainable development. Many legal scholars have lamented the limitations of the concept: in cases where no win/win outcome can be identified even after the most careful and coordinated measurement, they argue, the old power struggles between proponents of economics, environment, and equity will be entrenched. This Essay agrees that sustainable development, by definition, encompasses irresolvable tensions. But this fact becomes less troubling if we abandon the Enlightenment-influenced rationalism that demands such resolution, and instead consider sustainable development through more anti-rationalist traditions: the analytical psychology of Carl G. Jung, and …

Bearing Down On Trademark Bullies, Irina D. Manta

Fordham Intellectual Property, Media and Entertainment Law Journal

Trademark bullying has become a persistent problem, with large companies intimidating smaller entities with cease and desist campaigns and achieving anti-competitive results. A number of tactics exist to deal with bullying behavior. One of them is the imposition of judicial sanctions, but the standards in that area are unclear and the defendants often do not have the financial means to engage in litigation at all. Other, extralegal measures such as shaming have shown some success, but also present numerous drawbacks and prove insufficient when used against powerful actors.
