The Assault On Classical Legal Thought In Colombia (1886-1920), Jorge Gonzalez-Jacome Jan 2009

The Assault On Classical Legal Thought In Colombia (1886-1920), Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

The topic of this paper is the tensions among classical legal thought (CLT) and other modes of legal thought in Colombia between 1886 and 1920. My main claim is that, during this period, CLT was attacked by a version of traditionalism and by a social-based legal thought. The former was evident in the constitutional discussions around the 1886 Colombian Constitution, while the latter became apparent in the interpretation of the Civil Code in areas such as property, contracts and torts. My goal is to tell a story that gives a sense of the fall of CLT as a process crossed …

Discusiones Sobre La Educación Legal: ¿Cuál Es La Puerta De Entrada?, Jorge Gonzalez-Jacome Jan 2008

Discusiones Sobre La Educación Legal: ¿Cuál Es La Puerta De Entrada?, Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

Colonial Encounters In Modern [International] Law, Jorge Gonzalez-Jacome Jan 2008

Colonial Encounters In Modern [International] Law, Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

This is an unpublished work in which I am still working. It argues how the idea of exception in modern law is the place where colonialism is still deploying a particular dynamic naming the 'other' as someone who must be dehumanized and eliminated. Comments are welcome in the email address provided in the text.

Politizando La Inter-Relación Entre Derecho E Historia, Jorge Gonzalez-Jacome Dec 2007

Politizando La Inter-Relación Entre Derecho E Historia, Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

Reparations are a fundamental topic in law; not only in human rights but also in the basis of traditional areas such as civil law. In general terms, the expectation of reparation in law, produces a huge amount of cases and lawyers specialize in achieving that plaintiffs, when they claim against their aggressors, a tort would be ordered by a court of law. This article would like to question the way in which torts reparations are understood in cases of gross human rights violations, having as an example the Colombian armed conflict. In this paper I sustain that the classical/ individualistic …

Educación Jurídica: Ejercicio Político Desde La Técnica, Jorge Gonzalez-Jacome Jan 2007

Educación Jurídica: Ejercicio Político Desde La Técnica, Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

This article argues that there is a very vast complexity in the theory of sources of law. According to the traditional doctrine the sources are ordered in a coherent and precise manner and the interpreter has only to apply a clear hierarchy. However, looking at the way some judges in Colombia have applied their sources, it seems that the traditional way of looking to this problem is not an accurate description of what is happening in practice. Therefore, an alternative way of understanding the practice of our judges is proposed, in order to build a description that shows us in …

Esclavitud Perpetua: Construyendo Una Perspectiva De Raza En El Derecho Constitucional Colombiano, Jorge Gonzalez-Jacome Jun 2006

Esclavitud Perpetua: Construyendo Una Perspectiva De Raza En El Derecho Constitucional Colombiano, Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

The racial element in our society has been generally invisible to many of us. While slavery has been abolished, the process of making black people invisible has been effective. Two recent judgements of the Colombian Constitutional Court have made us think of the race problem as something meaningful in our society. Many difficulties arise in these judgements, and this article presents a critique to some of the legal arguments and consequences of them. It also sustains that the Court has still a long way to go in order to make the racial problem a visible one in our present state …

El Uso Del Derecho Comparado Como Forma De Escape De La Subordinación Colonial, Jorge Gonzalez-Jacome May 2006

El Uso Del Derecho Comparado Como Forma De Escape De La Subordinación Colonial, Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

The Colombian legal culture has not been able to make a fruitful use of the available methodologies in the area of comparative law. National doctrine has understood comparative law as a contrast between two legal provisions that belong to different legal systems without being aware that this kind of comparison is contributing to perpetuate old colonialist ideologies. This phenomenon is visible when Colombian doctrine compares our legal provisions with those issued in what might be called countries of the first world. Under this perspective, it appears that law travels from the civilized world to the uncivilized. Therefore, I think that …

Entre La Restricción Y La Libertad: Sobre La Posible Pérdida De Legitimidad Del Juez Constitucional, Jorge Gonzalez-Jacome Nov 2005

Entre La Restricción Y La Libertad: Sobre La Posible Pérdida De Legitimidad Del Juez Constitucional, Jorge Gonzalez-Jacome

Jorge Gonzalez-Jacome

There are different points of view from which legal reasoning can be examined. Some argue that there is a correct theory of legal reasoning and therefore, they analyze particular cases in order to determine if a particular argument drawn by a judge or a court is coherent with a proposed theory. One of the main assets of Critical Legal Studies (CLS) is to think about law as a practice in which there is no need to establish a particular theory to grasp reality. In the area of legal reasoning, Duncan Kennedy has tried to show us how the main concern …
