The Vice-Presidency And The Problems Of Presidential Succession And Inability, John D. Feerick
Fordham Law Review
This Article examines three interrelated subjects: the Vice-Presidency, the presidential succession law, and the inability provision of the Constitution. The first section provides a brief history of the Vice-Presidency. Then, the Article examines the various laws over the nation’s history that have set out a line of succession to the presidency. The Article concludes with a discussion of proposals for solving the gaps and ambiguities in the Constitution’s presidential inability provision. The author wrote this Article as he participated in the drafting of what would become the Constitution’s Twenty-Fifth Amendment.

The Problem Of Presidential Inability--Will Congress Ever Solve It?, John D. Feerick

This Article examines the problems posed by the gaps and ambiguities in the U.S. Constitution’s original provisions for presidential inability and succession. It explores relevant developments prior to and during the Constitutional Convention of 1787, recounts significant historical instances of presidential inability, and examines the succession provisions of state and foreign constitutions. The Article concludes with a proposal for a constitutional amendment to improve the provisions for presidential succession and inability.

The "Bill of Rights" provision of the Labor-Management Reporting and Disclosure Act of 1959 are designed to guarantee and protect employee representation in industrial government. The author, pointing to the method of Mr. Chief Justice Stone in Steele v. Louisville & N.R.R., suggests that the act's purpose may be advanced by an interpretation guided by the consitutional precedents applicable to public government.
