Survey Of Criminal Procedure — Alternative Dispositions Of Defendants, Charles Shafer
All Faculty Scholarship
The criminal justice system provides various alternatives for the disposition of criminal defendants. Three of these alternatives, pretrial intervention, drug treatment, and probation, were dealt with in recent New Jersey Supreme Court decisions. The court examined the substantive criteria and procedures used in assigning each disposition and focused primarily on the desire to provide rehabilitative opportunities for each defendant. This note will examine those decisions and the implications of the court's concentration on the goal of rehabilitation.

Maryland's boulevard rule has survived frequent challenge and the apparent harshness of its results in recent cases. The author examines the development and application of the rule and questions both the historical bases and judicial justifications for the rule's modern viability.

After reviewing Maryland law providing criminal penalties for the failure to support a spouse, child, or parent-in-need, the author presents a better way to deal with non-support — enactment of the Uniform Civil Liability for Support Act.

Punitive Damages In Tort Cases In Maryland, James F. Mccadden

The author discusses the Maryland law governing the recovery of punitive damages in tort actions. Centering on the recent court of appeals decisions in H & R Block, Inc. v. Testerman and Wedeman v. City Chevrolet Co., the author analyzes the distinction between actions for torts arising out of contracts and pure actions for torts, and concludes that the standards articulated in Testerman and Wedeman are those applicable to all punitive damages awards in Maryland cases.
