Paradise Lost: The Effect Of Judicial Review On Congressional Debate, Laura E. Jenkins
Paradise Lost: The Effect Of Judicial Review On Congressional Debate, Laura E. Jenkins
Dissertations - ALL
How does judicial supremacy affect constitutional deliberation in Congress? Normative critics of judicial supremacy argue that judicial supremacy warps congressional debate by disincentivizing members of Congress from independently considering the moral and legal issues at stake in legislation. As this dissertation’s quantitative analysis, topic modeling, and qualitative textual analysis show, the Supreme Court’s decision in National Federation of Independent Business v. Sebelius (2012) disincentivized members of Congress from engaging in independent constitutional interpretation and normative argumentation. Before the Supreme Court’s decision in Sebelius, members of both parties debated the constitutionality of the Affordable Care Act’s individual mandate and used constitutional …

Saving This Honorable Court: Supreme Court Legitimacy And Support For Court Reform, Nathan Thomas Carrington
Dissertations - ALL
For the first time in nearly a century, serious conversations are taking place involving re- form of the Nation's highest court. Scholarly wisdom holds that such discussions indicate a decrease of the Court's legitimacy which will have detrimental effects on the rule of law and minority rights. Indeed, several generations of political science scholarship have exam- ined the relationship between institutional support for the Supreme Court and its ability to exercise judicial power effectively, all finding a strong relationship. Do reform efforts actu- ally signal a collapse in Court legitimacy and the death of the rule of law as we …
Judicial Deference To Administrative Statutory Interpretation In The Modern American Administrative State, Rachel Marie Macmaster
Judicial Deference To Administrative Statutory Interpretation In The Modern American Administrative State, Rachel Marie Macmaster
Dissertations - ALL
The American administrative state of the twentieth and twenty-first centuries is defined by deference by federal courts to administrative agencies. The political science and (especially) legal literatures have long discussed how federal courts defer to agencies, but little attention has been dedicated to how to identify deference and why courts defer. This dissertation redefines deference, a term that has been topic of extensive discussion in the last forty years but that was missing a key feature: the intent of the deferrers. Using administrative courts as the proxy for agencies at large, this dissertation suggests three reasons why judges may defer. …

Motorcycle Fatality Rates Due To Head Injuries Are Lower In States With Helmet Laws, Mary E. Helander
Motorcycle Fatality Rates Due To Head Injuries Are Lower In States With Helmet Laws, Mary E. Helander
Population Health Research Brief Series
There are over 4,500 motorcycle crash fatalities per year in the U.S., on average. Roughly 37% of those deaths involve head injuries. Motorcycle helmet laws reduce fatalities, serious cognitive disabilities, and social costs. Yet many states have no helmet laws. This data slice shows that from 1999 to 2019, states with helmet laws had a 33% lower head-related fatality rate compared to states without helmet laws. Motorcycle helmet laws clearly save lives.

I will analyze different Latin American Supreme Court rulings in order to demonstrate that governments are obliged to cover universal medical treatments for people with HIV. This is a worldwide issue and UNAIDS is constantly working to protect this vulnerable group of people. We can see this progress in the following statistics.
The Pieces Of Housing Integration, Kristen Barnes
The Pieces Of Housing Integration, Kristen Barnes
College of Law - Faculty Scholarship
Notwithstanding the enactment of the Fair Housing Act in 1968, accomplishing racially-integrated housing across the United States remains an unattained goal. The costs associated with this failure are innumerable. Black Americans have endured harms in many areas, including health, education, wealth, and employment. More broadly, the nation has incurred considerable socioeconomic and political costs. In the interdisciplinary book, Moving Toward Integration, authors Richard Sander, Yana Kucheva, and Jonathan Zasloff analyze why the promise of racially-integrated housing remains unfulfilled and identify noteworthy strategies for changing course. Engaging with their arguments, this article highlights several structural impediments to altering racial housing …
Reframing Housing: Incorporating Public Law Principles Into Private Law, Kristen Barnes
Reframing Housing: Incorporating Public Law Principles Into Private Law, Kristen Barnes
College of Law - Faculty Scholarship
A new public-private law paradigm is developing with respect to the relationship of the state to private contracts. The paradigm melds private law concepts like unconscionability, good faith, and fair dealing with the public human rights principles of dignity and vulnerability. I trace this paradigm shift in the context of the housing law of Spain, where several rich cultural and legal resources have inspired a new sensibility with regard to residential mortgage loan contracts, rental agreements, and the overall duties and obligations of governments to address the citizenry's housing needs. Although this reorientation reflects decisions from the European Court of …

Institutional Death: Effects Of Carceral State And Education Institution On Black Men, Shontoria D. Pratt
African American Studies - All Scholarship
African American men have been dying at an alarming rate for many years. Issues such as violence, prison, education success rates, and health related issues, as well as institutional injustice, have been significant factors in these physical and mental deaths of African American men. The purpose of this research is to investigate the correlation, if any, between the quality of life of African American men in urban cities and their level of Afrocentric knowledge. To what extent does the exposure of Afrocentric knowledge affect the views or help African American men avoid these deaths? This research will present preliminary ideas …

The Rise Of Trump And The Death Of Civility, Keith Bybee
The Rise Of Trump And The Death Of Civility, Keith Bybee
Institute for the Study of the Judiciary, Politics, and the Media at Syracuse University
According to supporters and opponents alike, Donald Trump has been an unconventional candidate and president. In this article, I evaluate the relationship between Trump’s unconventional behavior and the requirements of civility. I provide a definition of civility, and I explain why it makes sense to relate Trump’s actions to civil norms. I then discuss how civility is enacted, I examine criticisms of civility’s triviality, and I explore the ways in which civility may repress dissent and maintain hierarchy. Although I consider the degree to which Trump’s actions are strategic, I ultimately argue that Trump’s incivilities should be understood as an …

Così Fan Tutte: A Better Approach Than The Right To Be Forgotten, Martha Garcia-Murillo, Ian Macinnes
Così Fan Tutte: A Better Approach Than The Right To Be Forgotten, Martha Garcia-Murillo, Ian Macinnes
School of Information Studies - Faculty Scholarship
In this article, we argue in favor of a macro-societal approach to protect people from the potential harms of personal information online. In the tension between information and privacy, “the right to be forgotten” is not an appropriate solution. Such a micro, individual-based answer puts the burden of protection on each person instead of on external entities that can abuse such knowledge. The personal responsibility to delete personal data is challenging because of the leakage of data that happens through the connections we have with others, many of whom do not share the same privacy preferences. We show that effective …

Financing Central Cities: The Economics Underlying Fiscal Strategy Options, Michael Wasylenko
Center for Policy Research
A consortium of Syracuse City and Onondaga County governments along with a number of local area non-profit organizations have recently organized a commission on Local Government Modernization for the Syracuse area. The Report makes three major recommendation to strengthen the local public sector in the Syracuse region: seek opportunities to share public services across local jurisdictions to reduce costs, adopt the Minneapolis region model for sharing revenues from new commercial and industrial development across localities, and work toward merging Syracuse City government with Onondaga County government. At the same time, current non-city residents would not have responsibility for the city …
The Effects Of State And Federal Mental Health Parity Laws On Working Time, Jinqi Ye
The Effects Of State And Federal Mental Health Parity Laws On Working Time, Jinqi Ye
Center for Policy Research
This paper provides new empirical evidence on the impacts of state and federal mental health parity laws on related labor market outcomes, particularly working time. Implemented in the last two decades, these policies aim to eliminate differences in mental and physical health benefits among group health plans. The mandated benefits for mental health drive up the costs of providing health insurance substantially. In response, employers may avoid hiring more full-time workers, whose compensation includes health insurance, by increasing working time per worker and reliance on part-time employment. Employees may also have an incentive to increase their labor supply to qualify …

My Grandmother Was Mrs. Palsgraf: Ways To Rethink Legal Education To Help Students Become Lawyers, Rather Than Just Thinking Like Them, Ian Gallacher
College of Law - Faculty Scholarship
This article uses my family history, and its striking similarities to the Palsgraf case, as a starting point for a consideration of the ways law schools teach the law to their students, the problems that approach appears to cause, and some possible alternative, and potentially healthier, approaches to legal education.
My grandmother, grandfather, mother, and uncle were all in a house that was blown-up and destroyed by a bomb during the Second World War. And while the cause of the explosion was very different to that in Palsgraf, the fact of an explosion that drastically changed the lives of …

Research Brief: "Military Sexual Trauma Among Recent Veterans: Correlates Of Sexual Assault And Sexual Harassment", Institute For Veterans And Military Families At Syracuse University
Institute for Veterans and Military Families
This study examines the population prevalence of military sexual trauma among OEF/OIF-era veterans. It found that almost 41% of women and 4% of men reported a military sexual trauma, indicating a high prevalence of OEF/OIF-era veterans who have experienced an MST. In practice, servicemembers and veterans who have experienced a military sexual trauma (MST) should seek medical help, such as counseling. In policy, the Department of Defense (DoD) might continue its efforts to reduce negative repercussions often associated with reporting sexual assault or sexual harassment. Suggestions for future research include having more data on the prevalence of MST in the …

"No Country For Old Men": Junior Associates And The Real-World Practice Of Law, Ian Gallacher
College of Law - Faculty Scholarship
Law schools are designed to teach students about the doctrine of law and to help them prepare their skills to practice law. There are some practical aspects of law practice, though, that are rarely if ever discussed in law school. Perhaps this is because of an assumption that law firms will make these issues clear to the students they hire as associates, or perhaps it is because of a belief that such information has no place in the curriculum of an academic institution.
Whatever the reason, this is information law students should have as they begin to think about where …
Hate Speech And Double Standards, Thomas M. Keck
Hate Speech And Double Standards, Thomas M. Keck
Political Science - All Scholarship
Many European states ban the public expression of hateful speech directed at racial and religious minorities, and an increasing number do so for anti-gay speech as well. These laws have been subjected to a wide range of legal, philosophical, and empirical investigation, but this paper explores one potential cost that has not received much attention in the literature. Statutory bans on hate speech leave democratic societies with a Hobson’s choice. If those societies ban incitements of hatred against some vulnerable groups, they will inevitably face parallel demands for protection of other such groups. If they accede to those demands, they …

Addressing The 'Failure' Of Informed Consent In Online Data Protection: Learning The Lessons From Behaviour-Aware Regulation, Shara Monteleone
Syracuse Journal of International Law and Commerce
Information notice and data subject's consent are the current main legal safeguards of data protection and privacy rights: they reflect individuals' instances, such as self-determination and control over one's own private sphere, that have been acknowledged in many jurisdictions. However, the theoretic strength of these safeguards appears frustrated by current online practices that seem suggesting to give-up with their most common form of implementation: privacy notices and request for consent. These measures are proving to be unsuccessful in increasing users' awareness and in fostering a privacy protective-behaviour. As recent studies have shown, although people declare privacy concerns, their actual behaviour …
