Some Effects Of European Law On English Administrative Law, Yvonne Cripps

Indiana Journal of Global Legal Studies

In this article, Dr. Cripps discusses how European law has

affected English law in recent decades, particularly with regard to

the constitutional supremacy enjoyed by the English legislative

branch. She notes the reception by English judges of concepts of

legitimate expectation and proportionality previously recognized in

some European Community nations. Dr. Cripps predicts that the

English bench will be increasingly willing to take European law

into account in their decisionmaking.

A View From The United States - Social, Economic, And Legal Change, The Persistence Of The State, And Immigration Policy In The Coming Century, John Scanlan

Indiana Journal of Global Legal Studies

In this article, Professor Scanlan argues that in spite of recent

trends toward globalism, traditionally composed nation-states,

especially the United States, will continue to exercise localized

control over immigration and receiving nations may pursue

increasingly restrictive policies. The author begins with a history

of recent U.S. and European Union (EU) immigration policies,

positing that State self-interest has always played a central role.

Next, he traces the post-World War II development of the

"international refugee regime" as well as the development of the

European Union's "open"- labor market. Professor Scanlan

predicts that international agencies will become less efficacious for

Global Migration - Immigration - Multiethnicity: Challenges To The Concept Of The Nation-State, Jost Delbruck

Indiana Journal of Global Legal Studies

Professor Delbriick begins his article by briefly discussing the

history and development of the nation-state, and then examines how

changes in the political and social environment, often international

and cross-cultural in nature, have altered the traditional notion of

the nation-state. He argues that the modern form of the State

should be based on the concept of the "Open Republic, " rather than

on that of the traditional closed, self-centered, and self-reliant

nation-state. Professor Delbriick demands that his concept of an

"Open Republic" first be grounded in the form of a republican

A World Of Regions: America, Europe, And East Asia, Peter J. Katzenstein

Indiana Journal of Global Legal Studies

Recent events in world politics are creating a substantial break in the

history of international politics comparable in this century only to the years

1917-22 and 1947-53. With specific reference to Germany and Europe as

well as to Japan and East Asia, this essay argues that these changes in world

politics tend to reinforce a new political regionalism that expresses different

norms, which, in the foreseeable future, are unlikely to be assimilated fully

into one normative global order.

European Integration: Reflections On Its Limits And Effects, William J. Davey

Indiana Journal of Global Legal Studies

One of the principal goals of this journal is to evaluate the impact of the

globalization of law, politics, and markets. This article focuses on the

economic integration of markets in Europe, where one aspect of the

"globalization" process-the process by which laws, national economies, and

political systems are becoming ever more entwined and interdependent-has

occurred to the greatest extent, albeit at a regional level. I will first give an

overview of this process and consider the factors that the European

experience in "regionalization" suggests may limit economic and other forms
