The Act provides that youths convicted of driving with alcohol in their blood shall be confined at a camp, institution, or, if neither of those are available, a regional youth detention center, and the youth shall be segregated from youths convicted of other offenses. Youths under the age of twenty-one convicted of driving with a blood alcohol concentration of 0.02 grams to 0.07 grams shall be required to perform twenty hours of community service for a first offense and forty hours for a second. The Act relates to juvenile proceedings. It provides that superior courts shall have exclusive jurisdiction over the trial of certain felony offenses involving juveniles and also provides that those offenses are bailable only before a judge of the superior court. Further, the Act states that certain designated felonies are not subject to informal adjustment without notifying the district attorney. The Act also adds battery of a teacher or other school personnel, racketeering, theft of a motor vehicle, and acts of the juvenile relating to escape to the list of "desginated felonies." The Act amends four sections of Title 20 and adds two new sections. Section 1 of the Act allows the Georgia Board of Education more flexibility in paying fees for advances placement tests. Section 2 provides more flexibility regarding school funding. Section 3 addresses the way in which Georgia's educators assess students receiving special education services. Section 4 freezes maximum class sizes for grades 4 through 12 for one year. The Act requires public employers to participate in a federal work authorization program to verify lawful presence and employment eligibility of all newly hired employees. Contractors who bid for public work must also register with the federal work authorization program and must verify related information regarding all new employees and subcontractors. The Act also requires county and municipal jail authorities to make an effort to determine the nationality of people confined; regarding certain charges, the jailer must make an effort to ensure that the prisoner has been lawfully admitted to the United States. The Act creates a state-level commission to authorize charter schools and cosponsors these charter schools. If a charter school petition is denied by a local board of education, the petititoner may submit the petition to the commission for approval unless the school would be located in a charter system. The bill would require all female students entering sixth grade to be vaccinated against the human papillomavirus. Exceptions were provided for children whose parents objected on religious grounds. The bill would have also suspended the vaccination requirement in cases of insufficient supplies of the human papillomavirus vaccine. The bill would have left unchanges requirements that schools keep records of the immunizations and report to the Department of Human Resources annually.
