Australian Icons: Authenticity Marks And Identity Politics, Matthew Rimmer

This article evaluates the adoption and implementation of an Indigenous certification trademark system in Australia. Section II considers the use of copyright law, moral rights provisions and consumer protection laws to protect Indigenous cultural property in Australia. It suggests that there needs to be additional protection under trademark law - especially to deal with problems concerning communal ownership, material form and duration of protection. Section III evaluates the efficacy of the scheme for marks of authenticity established by the National Indigenous Arts Advocacy Association in November 1999. When Laws Backfire: Unintended Consequences Of Public Policy, Roger Roots

Why is it that so many laws perpetually fall short of their intended goals? Why haven’t humanity’s greatest minds managed to solve basic social ills? This article amasses considerable evidence suggesting that (a) law is inherently incapable of producing major social change because legal restrictions unsettle social equilibria and generate counteractions and (b) the subconscious purpose behind many laws is the promotion of social solidarity for its own sake. The author concludes that laws and the politics that forge them are essentially religious practices that have little basis in rational analysis. Thus can be explained both the perpetual failure of …

The official motive for the enactment of the Road Accidents' Victims Compensation Act of 1975 was a social one. According to the traditional view, the Act was meant to guarantee an appropriate and immediate compensation to all victims of road accidents. The abolishment of fault, the expansion of mandatory insurance, and the establishment of the Road Accidents' Victims Compensation Fund (Karnit) were supposed to turn the dream into reality. Furthermore, in order to aid the victim and avoid undue pressure to compromise, the legislature granted the victim the right to immediate (interim) payments. "Is The Wheel Unbalanced?: A Study Of Bias On Zoning Boards", Jerry L. Anderson

This article describes an empirical study of the occupational composition of zoning boards in Iowa. The study finds that both zoning adjustment boards and planning commissions are heavily weighted toward white-collar professionals; labor and agricultural interests are significantly under-represented. Moreover, the study finds that boards are heavily populated with those who stand to gain from property development. The study recommends that legal restrictions on board appointments be tightened to ensure a better cross-section of the community is represented.

Empirical investigation of public usage of the word "progress" in the United States of 1789 demonstrates that the word meant "dissemination." The original meaning of art. I, sec. 8, cl. 8, therefore, is that Congress has the right to grant only such temporally limited exclusive rights in writings and new technology as encourage the dissemination of knowledge and new technology to the population. This article explains the major differences between current United States positive intellectual property law and the logical dictates of this original constitutional meaning. The issue of palliative care, which is increasingly at the heart of the end-of-life discourse in the international legal community, has receive, surprisingly, little to no attention in Israel. Critical legal theory should be more widely taught as a useful way of analyzing the law. Recent critiques of CLS do not diminish its usefulness as a tool for teaching critical thinking. Many professors, however, find it difficult to convey the essential concept of CLS in a way students can grasp. This article suggests that the popular movie "The Matrix" may provide a method of explaining critical theory to students.

Sesame is one of the important oilseeds crop in India, which plays a major role in supplementing the income of small and marginal farmers of Sunderbans. One of the major constraints of traditional Sesame farming is low productivity of local varieties. To replace this anomaly, Krishi Vigyan Kendra of CIFRI has conducted frontline demonstration at adopted farmers’ field in four development blocks viz. Kakdwip, Namkhana, Patharpratima and Kulpi of Sunderbans, West Bengal. Cultivation of high yielding varieties of Sesame viz. Rama (Improved Selection-5) and Tilottma (B-67) shows percentage increase of 46.58 and 35.86 respectively over local check. The technology gap …
