Access To Justice For Women: : India's Response To Sexual Violence In Conflict And Social Upheaval, Laurel E. Fletcher, Roxanna Altholz, Angana P. Chatterji, Mallika Kaur

Laurel E. Fletcher

Access to Justice for Women: India’s Response to Sexual Violence in Conflict and Social Upheaval (Report) examines four examples of sexual violence against women in the Indian states of Punjab, J&K, Gujarat, and Odisha.

The case examples focus on the efforts of female victims of sexual violence and their allies to seek justice and the response of the Indian justice system to these crimes. The four examples represent a diverse range of incidents and legal outcomes, all of which gained significant attention within each region, if not nationally and internationally.

Law, Science, And The Economy: One Domain?, David S. Caudill Dec 2014

Law, Science, And The Economy: One Domain?, David S. Caudill

David S Caudill

In an effort to explore the theoretical and practical promise of ignoring or erasing conventional boundaries and distinctions—such as law/society or inside/outside—in accounts of legal processes and institutions, I consider the problem of financial bias in scientific expertise. I first draw an analogy with science studies, and particularly Latour’s notion of science as a coproduction, which challenges the boundaries (i) between science and society, and (ii) between natural and social influences on the production of scientific knowledge. I then acknowledge the efforts of Philip Mirowski, in his concern that privatization trends degrade science, to overcome an individualistic perspective on financial …

Empirical Studies Of Claim Construction, Jonas Anderson Dec 2014

Empirical Studies Of Claim Construction, Jonas Anderson

J. Jonas Anderson

Patent claims define the scope of the patent right and hence are central to the operation of the patent system. Patent prosecutors devote substantial effort to crafting patent claims so as to maximize the scope of their right without “reading on” prior art (and thereby defeating novelty). Businesses seeking to enter a technology marketplace must be careful to avoid encroaching patent claims. Thus, when patentees enforce their rights, the interpretation of claim boundaries guides both validity and infringement analysis. Following the Supreme Court’s decision in Markman v. Westview Instruments (517 U.S. 370 (1996)), holding that “the construction of a patent, …

Lemons On The Edge Of The Internet: The Importance Of Transparency For Broadband Network Quality, Reza Rajabiun, Catherine Middleton Dec 2014

Lemons On The Edge Of The Internet: The Importance Of Transparency For Broadband Network Quality, Reza Rajabiun, Catherine Middleton

Reza Rajabiun

Network performance measurements from OECD countries between 2007 and 2012 document a significant increase in the variability of broadband infrastructure quality, which helps explain growing demand for technologies and policies that counteract information asymmetries between network operators and end users. A cross-country analysis documents the negative association between quality uncertainty and variations in digital infrastructure quality. The analysis suggests public policies and business models that promote market transparency can enhance the efficiency of the broadband access market on the edge of the internet and stimulate incentives for the diffusion of next generation platforms.

Women Made Whole: How Tort Law Can Change The Lives Of Domestic Violence And Sexual Assault Victims, Sara L. Crewson Dec 2014

Women Made Whole: How Tort Law Can Change The Lives Of Domestic Violence And Sexual Assault Victims, Sara L. Crewson

Sara L Crewson

Domestic violence victims do not have the same level of access to the civil justice system that victims of sexual assault do, yet both are gender-linked crimes. A combination of legal, legislative, and social forces have come together to effectively bar recovery for victims of domestic violence, but when examining how these forces serve to help, rather than hinder, sexual violence victims, it is possible to come up with solutions that can tear these barriers down and ensure all victims of violence are equal in the eyes of the justice system. What we know is that domestic violence tort claims …

The Solemn Moment: Expanding Therapeutic Jurisprudence Throughout Estate Planning, Mark Glover Dec 2014

The Solemn Moment: Expanding Therapeutic Jurisprudence Throughout Estate Planning, Mark Glover

Mark Glover

Estate planning involves much more than visiting a lawyer and executing a will. Indeed, contemporary estate planning employs various will substitutes, such as life insurance, revocable trusts, and payable-on-death contracts, to transfer the client’s property upon death. Because estate planning, including the use of will substitutes, requires the client to confront the inevitability of death, it can affect the client’s psychological wellbeing. Recognizing the connection between estate planning and mortality, a handful of scholars have drawn attention to the psychological implications of estate planning, the law of succession, and the probate process. While this prior work sheds important light on …

Restoring The Fact/Law Distinction In Patent Claim Construction, Jonas Anderson Dec 2014

Restoring The Fact/Law Distinction In Patent Claim Construction, Jonas Anderson

J. Jonas Anderson

INTRODUCTION: Two decades ago, the Supreme Court sought to promote more effective, transparent patent litigation in Markman v. Westview Instruments1 by ruling that "the construction of a patent, including terms of art within its claim, is exclusively within the province of the court."'2 In so doing, the Court removed interpretation of patent claims from the black box of jury deliberations by holding that the Seventh Amendment right to a jury trial did not extend to patent claim construction. Failing to find clear historical evidence of how claim construction was handled in 179 1,' the Court turned to "the relative interpretive …
