The copyright fair use caselaw is more coherent and more predictable than many commentators seem to believe. Fair use cases tend to fall into common patterns, or what this Article calls policy-relevant clusters. The policies underlying modern fair use law include promoting freedom of speech and of expression, the ongoing progress of authorship, learning, access to information, truth telling or truth seeking, competition, technological innovation, and the privacy and autonomy interests of users. If one analyzes putative fair uses in light of cases previously decided in the same policy cluster, it is generally possible to predict whether a use is …

The article discusses the relevance of revising the U.S. Copyright Act of 1976. According to the author, the Copyright Act of 1976 has already undergone more than 20 amendments since it was ratified into law which compromises its regulations because of the diverse inter and intra industrial negotiations as well as increases controversial issues on law and policymaking. Moreover, the author stresses that revision of the legislation is necessary because it contains lapses and insufficient policies in addressing advanced technological innovations and digital applications. An essay is presented on letters from professor Pamela Samuelson to the court in the U.S. regarding concerns on copyright issues surrounding the proposed Google Book Settlement. In the April 2009 letter, Samuelson criticized a settlement agreement in a suit filed by the Association of American Publishers (AAP) to Google Inc. for copyright infringement on the Google Book Search. However, in the September 2009 letter, her concerns and thoughts on the future of copyright are emphasized.

The author examines the case for copyrighting computer programs in relation to the 1970 article “The Uneasy Case for Copyright: A Study of Copyright in Books, Photocopies, and Computer Programs,” by U.S. Supreme Court Justice Stephen Breyer. The number of programs registered with the Copyright office has reportedly bolstered Breyer's skepticism about such copyright. The risks posed by copyrighting programs were of concern to Breyer. Also assessed is the development of the software industry.

Widespread adoption of uniform standards is essential to the smooth operation of our modern global economy. When private organizations develop such standards, copyright protection of those standards often creates a conflict between private intellectual property rights and society's need for standards. This conflict is especially apparent when a local or state government adopts a privately drafted standard as law. This Article explains that certain features of U.S. law, particularly copyright law, contributed to Google's willingness to undertake the Google Book Search (GBS) project in the first place and later to its motivation to settle the lawsuit charging Google with copyright infringement for scanning in-copyright books. Approval of this settlement would achieve several copyright reforms that Congress might find difficult to accomplish, some of which would be in the public interest.
