The Law Office Search: An Emerging Problem And Some Suggested Solutions, Lackland H. Bloom Jr.

A law office search threatens the attorney-client relationship by jeopardizing values protected by the fourth, fifth, and sixth amendments. After reviewing recent developments that underlie the sudden emergence of the law office search, Professor Bloom examines the nature of this threat and suggests that the values of the attorney-client relationship can be reconciled with the needs of law enforcement by requiring the police to use a subpoena rather than a search warrant when seeking documentary evidence from an attorney. Article 2212a of the Texas Revised Civil Statutes, the Comparative Negligence and Contribution Among Joint Tortfeasors Act, took effect on September 1, 1973. It made significant changes in the respective rights and liabilities of injured persons and tortfeasors in negligence cases. This paper is principally concerned with multiple tortfeasor cases, and with section 2 of article 2212a, which modified principles concerning joint and several liability, contribution, and settlement. Prior to the enactment of article 2212a, each tortfeasor whose negligent behavior proximately caused an indivisible injury to another was jointly and severally liable to the injured party. The publicity attendant upon the "energy crisis" confronting the United States and increasing prices for oil and gas have induced growing percentages of landowners or mineral interest owners' and oil and gas operators negotiating oil and gas leasing transactions to seek legal counsel at some point in their negotiations. An oil and gas operator usually consults either staff legal counsel or a law firm which represents other oil and gas operators, so that as a general rule operators are served by legal counsel who are familiar with the problems involved in leasing transactions and with the particular characteristics of their …

Voir Dire Of Jurors: Constitutional Limits To The Right Of Inquiry Into Prejudice, Jeffrey M. Gaba

Although the voir dire of jurors is one of the most significant mechanisms by which an impartial jury is secured, as a practical matter the right to examine prospective jurors is not unlimited. Vested with great discretion, a trial judge may at some point constitutionally preclude inquiry into possible prejudice, but determining that point has not proved to be easy. In 1976, the Supreme Court in Ristaino v. Ross directly considered the constitutional limits to voir dire and provided a test which could serve as a guide to trial court administration of the process. Most writers of legal literature are human. Most humans are male or female. Some males and females marry. Some writers of legal literature marry. Indeed, some writers of legal literature are probably married when they write their legal literature. The influence of the spouse on the writing of legal literature has never been explored. This article addresses this question.

Although the Commercial Code of 1960 contemplates the promulgation of a special law governing industrial property rights, the Imperial Ethiopian Government has neither promulgated this law nor, with the exception of a draft trademark law, prepared the appropriate draft legislation. The lack of a comprehensive law has not been disastrous: until recently the number of trademarks and industrial inventions used or created in Ethiopia was very small.
