Garnishment Of Public Corporations, Jeff B. Fordham
Garnishment Of Public Corporations, Jeff B. Fordham
West Virginia Law Review
The notion that garnishment of public corporations is against public policy early took root in the minds of American judges. The history of the subject is an interesting commentary on the growth of our law. The policy objection, based principally on the avoidance of inconvenience to public administration, has been accorded wide judicial acceptance with only occasional reconsideration on the merits. Stare decisis and that characteristic, but for the most part commendable, conservatism of bench and bar have done their part to entrench the doctrine. Judicial revolt against it, which has occurred largely in cases involving municipalities, has made only …

Bulk Sales Laws: A Study In Statutory Interpretation, Thomas Clifford Billig, Kingsley R. Smith
West Virginia Law Review
This article is the second of a series which proposes to deal with several aspects of bulk sales legislation. The first paper, entitled "Bulk Sales Laws; A Study in Economic Adjustment" appeared in the November, 1928 issue of the University of Pennsylvania Law Review. That discussion considered three phases of the bulk sales problem: (1) the inability of the American statutory successors of 13 Elizabeth to meet the legal needs of the creditor class when a defrauding merchant sold out in bulk his stock of unpaid for goods to a bona fide purchaser for value;(2) the campaign waged by the …
The West Virginia Municipal Home Rule Proposal, Jeff B. Fordham
The West Virginia Municipal Home Rule Proposal, Jeff B. Fordham
West Virginia Law Review
In the first instalment of this paper, which appeared in the last issue of the Quarterly, it was sought to present an outline picture of the legal position of municipalities in West Virginia's governmental system upon a background of appropriate historical materials. The immediate purpose is to consider the home rule proposal which has appeared on the scene so depicted.

Pleading And Practice Under The Revised Code, Lawrence R. Lynch
West Virginia Law Review
In a paper of limited length such as this necessarily must be, it is impracticable to discuss or even to mention many of the changes in pleading and practice contained in the Revised Code. For that reason this discussion will be confined primarily to some important and interesting changes in Chapter 56, entitled "Pleading and Practice." At the outset it may be said that the revisers have retained the common law system of pleading and procedure. They declined follow in the steps of those jurisdictions which have adopted what is known as code pleading and practice. Such changes as the …

A Legislative Reference Bureau For West Virginia, Maurice T. Van Hecke
West Virginia Law Review
This paper suggests the benefits that might be derived from the establishment and maintenance of a legislative reference bureau in West Virginia. Similar agencies are now functioning in a majority of the states and at the national capital. It is understood that a need for such a bureau has developed in this state, and that a bill providing for the creation of a legislative reference bureau will be presented to the legislature at this session.
