As’Lem: An Ethical Diagnosis Of The Contemporary, Miriam Ticktin Apr 2017

As’Lem: An Ethical Diagnosis Of The Contemporary, Miriam Ticktin

Publications and Research

In recent scholarly literature, refugees have proliferated: they are the “political figures par excellence” and “border concepts”; they are understood through their infrastructures, both camps and laws; and they are approached as suffering subjects. But Fassin, Wilhelm-Solomon, and Segatti have a different approach: they understand asylum—or as’lem, the term used by asylum seekers in South Africa—as a form of life.

Currently, homosexuality is criminalized in Morocco under the Moroccan Penal Code Article 489 and most Moroccans view homosexuality as haram, prohibited by god. The LGBT+ community faces religious, legal and social pressures and persecution. Still, LGBT+ people continue to fight for their right to exist in Morocco and activists are working to protect members of the community from legal prosecution as well as form safe spaces for their community. At the same time, many members of the LGBT+ community in Morocco must emigrate to live their lives both honestly and safely. This paper aims to explore the current circumstances …

Structures, Norms, And Renewable Energy Policy: A Comparative Analysis Of The Driving Forces Behind Energy Policymaking In The United States And Denmark, Elise Ogden Apr 2017

Structures, Norms, And Renewable Energy Policy: A Comparative Analysis Of The Driving Forces Behind Energy Policymaking In The United States And Denmark, Elise Ogden

Senior Theses and Projects

The 1973 OPEC Oil Embargo served as a wake-up call for many highly oil dependent countries, including the United States and Denmark. In the wake of the 1973 oil crisis, the U.S. and Denmark had very different policy responses. Denmark identified oil itself as the underlying issue, and quickly transitioned to alternative energy sources, including wind. Today, Denmark is a global leader in renewable energy usage and sustainability. The United States, on the other hand, saw foreign reliance on oil as the main issue, and moved to develop domestic oil reserves rather than transitioning to alternative sources. Today, the U.S. …

My Company Is Freezing The Pension Plan: What Does This Mean?, Pension Action Center, Gerontology Institute, University Of Massachusetts Boston

Pension Action Center Publications

As employers move away from traditional defined benefit pension plans in favor of defined contribution 401(k) plans, the number of frozen pension plans is rapidly increasing. While most companies would like to rid themselves of their pension plan liabilities, more often than not, employers deem it too costly to terminate their existing plans and pay out all accrued benefits to participants and beneficiaries. As a result, instead of terminating their existing pension plans, many employers are electing to “freeze” their plans. Pension plans may be frozen using a “hard freeze” or a “soft freeze”. While both types of plan freezes …

Lump Sum Vs Annuity Payments: Which Is Right For Me?, Pension Action Center, Gerontology Institute, University Of Massachusetts Boston

Pension Action Center Publications

As employers are looking to reduce pension plan liabilities, more and more participants are being given the option to receive a one-time lump sum payment from their pension plan in lieu of receiving monthly annuity payments for life. Deciding on which form of pension benefit to take is a very important decision that requires careful consideration. Unfortunately, there is no one-size-fits-all answer. While a lump sum may make sense for one person, it may be a serious mistake for another. And it is a decision that you will have to live with for the rest of your life. Anyone who …

Defining Biometrics: Toward A Transnational Ethic Of Personal Information, Nicola Morrow Apr 2017

Defining Biometrics: Toward A Transnational Ethic Of Personal Information, Nicola Morrow

International Studies Honors Projects

Innovations in biotechnology, computer science, and engineering throughout the late 20th and early 21st centuries dramatically expanded possible modes of data-based surveillance and personal identification. More specifically, new technologies facilitated enormous growth in the biometrics sector. The response to the explosion of biometric technologies was two-fold. While intelligence agencies, militaries, and multinational corporations embraced new opportunities to fortify and expand security measures, many individuals objected to what they perceived as serious threats to privacy and bodily autonomy. These reactions spurred both further technological innovation, and a simultaneous proliferation of hastily drafted policies, laws, and regulations governing the collection, …

Judicial Supremacy Revisited: Independent Constitutional Authority In American Constitutional Law And Practice, Mark A. Graber Apr 2017

Judicial Supremacy Revisited: Independent Constitutional Authority In American Constitutional Law And Practice, Mark A. Graber

William & Mary Law Review

The Supreme Court exercises far less constitutional authority in American law and practice than one would gather from reading judicial opinions, presidential speeches, or the standard tomes for and against judicial supremacy. Lower federal court judges, state court justices, federal and state elected officials, persons charged with administering the law, and ordinary citizens often have the final say on particular constitutional controversies or exercise temporary constitutional authority in ways that have more influence on the parties to that controversy than the eventual Supreme Court decision. In many instances, Supreme Court doctrine sanctions or facilitates the exercise of independent constitutional authority …

A Forensic Email Analysis Tool Using Dynamic Visualization, Johannes Stadlinger, Andreas Dewald

Journal of Digital Forensics, Security and Law

Communication between people counts to the most important information of today’s business. As a result, in case of forensic investigations in big companies, analysis of communication data in general and especially email, as the still most widely used business communication platform with an immense and still growing volume, is a typical task in digital forensics. One of the challenges is to identify the relevant communication partners and structures in the suspects surrounding as quickly as possible in order to react appropriately and identify further targets of evaluation. Due to the amount of emails in typical inboxes, reading through all the …

Compression Of Virtual-Machine Memory In Dynamic Malware Analysis, James E. Fowler Ph.D. Mar 2017

Compression Of Virtual-Machine Memory In Dynamic Malware Analysis, James E. Fowler Ph.D.

Journal of Digital Forensics, Security and Law

Lossless compression of memory dumps from virtual machines that run malware samples is considered with the goal of significantly reducing archival costs in dynamic-malware-analysis applications. Given that, in such dynamic-analysis scenarios, malware samples are typically run in virtual machines just long enough to activate any self-decryption or other detection- avoidance maneuvers, the virtual-machine memory typically changes little from that of the baseline state, with the difference being attributable in large degree to the loading of additional executables and libraries. Consequently, delta coding is proposed to compress the current virtual-machine memory dump by coding its differences with respect to a predicted …

How Could Repealing Key Provisions Of The Affordable Care Act Affect Community Health Centers And Their Patients?, Sara J. Rosenbaum, Jessica Sharac, Thao-Chi Tran, Anne Rossier Markus, David Reynolds, Peter Shin

Geiger Gibson/RCHN Community Health Foundation Research Collaborative

Analyses of repeal of the Affordable Care Act (ACA) have tended to focus on coverage. This study, which gauges the potential effects of repealing certain ACA provisions, looks at the question of primary health care access itself, with a focus on medically underserved communities. A survey developed and fielded in early 2017 asked community health centers to estimate the impact of ending the Health Centers Fund established under the ACA as well as ending expanded Medicaid coverage and subsidies designed to make private insurance affordable for lower income patients. Forty-one percent of health centers responded; 69 percent were located in …

No More Starving Artists: Why The Art Market Needs A Universal Artist Resale Royalty Right, Allison Schten Mar 2017

No More Starving Artists: Why The Art Market Needs A Universal Artist Resale Royalty Right, Allison Schten

Notre Dame Journal of International & Comparative Law

Artists often struggle to make a living because they see profits only from the first sales of their work. Unlike other creative arts, where the creator can earn a living via sales of books or music, an artist’s product is valuable for its singularity. Droit de suite, or the artist resale royalty right, allows artists to recover a percentage of profits from resales of their work. Implementing resale royalty schemes has been a subject of controversy worldwide due to fears that the art market will relocate to areas without such additional transaction costs—but broad-scale, international implementation of droit de …

Daily Fantasy Sports Go “All In”: The Demise Of American Morals?, James Schwabe

Notre Dame Journal of International & Comparative Law

The future of Daily Fantasy Sports throughout the United States remains uncertain. Although there have been numerous attempts to double down on the spread of gambling, the growing attraction to gamble has not been suppressed. With the recent proposed legislation and litigation over the legality of Daily Fantasy Sports, a new debate has emerged that implicates America’s desire to protect its “public morals.” Part I of this Note will discuss the intricacies of Daily Fantasy Sports and the allegations against FanDuel and DraftKings as of February 2016. Part II will analyze the current legal framework surrounding global internet gambling and …

Cracking The Toughest Nut: Colombia's Endeavour With Amnesty For Political Crimes Under Additional Protocol Ii To The Geneva Conventions, Marie-Claude Jean-Baptiste

Notre Dame Journal of International & Comparative Law

After years of negotiations, the Colombian government and the Revolutionary Armed Forces of Colombia have reached an unprecedented peace agreement. The agreement, rooted in transitional justice, contains a strong and nuanced focus on political amnesty for rebel forces. The scope and nature of the agreement has garnered international attention and praise. Of particular interest is whether the amnesty provision under the peace agreement is compatible with international law. This legal brief tracks the contours of existing international law on amnesty for political crimes—specifically under Additional Protocol II to the Geneva Conventions—to analyze this compatibility. The conclusion is that all relevant …
