Liberals and progressives have been slow to realize that their preferred vocabulary has been hijacked and that when they respond to once hallowed phrases they are responding to a ghost now animated by a new machme. The point is not a small one, for in any debate, especially one fought in the arena of public opinion, the battle is won not by knock-down arguments but by the party that succeeds in placing its own spin on the terms presiding over the discussion.

Victims Confront Offenders: An Exploratory Study Of Victim Satisfaction During Mediation, Krystal C. Walton

The purpose of this study was to determine if age, race, and gender were related to victim satisfaction during mediation while controlling for the type of offense. Satisfaction with the mediator's attitude, the session itself, the mediator, and the outcome were assessed to measure the victim's level of satisfaction with the various components of the mediation process. Data was collected from questionnaires mailed to crime victims' who had completed the mediation process through the Juvenile and Domestic Relations Court in Norfolk, Virginia. Delinquency And Victimization Among Adolescents An Examination Of The Relationship And Lifestyle Influences, Joy Eileen Livergood

This research examines the correlation between delinquency and victimization. Consideration is given to the lifestyle influences including the routine activities and demographic factors. Data from the 1997 Monitoring the Future data set are analyzed in an attempt to understand the extent of the relationship as well as the impact of various lifestyle activities and demographic factors. The study was guided by previous research examining the correlation between delinquency and victimization as well as the impact of lifestyle elements. SPSS 9.0 for Windows was used to analyze the data. Overall, the findings suggest that there is a correlation between delinquency and …

Long-Term Outcomes Of An Abstinence-Based, Small-Group Pregnancy Prevention Program In New York City Schools, Lisa D. Lieberman, Heather Gray, Megan Wier, Renee Fiorentino, Patricia Maloney

Context: Despite drops in U.S. teenage birthrates, questions continue to arise about how best to reduce the country's adolescent birthrate. School-based programs continue to be considered one of the best ways to reach adolescents at risk of early sexual activity.
Methods: A total of 312 students completed a pretest, a posttest and a follow-up one year after the posttest: 125 who had participated in a 3-4-month-long abstinence-based small-group intervention led by trained social workers, and 187 in a comparison group that received no special services.
Results: There were few significant differences between the intervention and comparison groups at posttest. At …

Rights And Obligations Of Third Parties, Aristides N. Hatzis
Aristides N. Hatzis
Three different issues, related to third party involvement in a contractual relationship, are examined. The first two (assignment of contractual rights/delegation of contractual duties and third-party beneficiary contracts) are examined in a unified way. After pointing to the striking similarity between beneficiary and assignment contracts, we discuss the non-simultaneous assent argument, the danger of creating open classes of beneficiaries without the intention of the contracting parties, and other problems. In a second part, we deal with the controversial issue of efficient breach due to inducement by a third party. After reviewing the literature, we briefly consider the use of liquidated …

Injunctions Restraining Calls On Performance Bonds: Is Fraud The Only Ground In Singapore?, Quentin Loh, Hang Wu Tang

This paper traces the divergence of Singapore law from English law with regard to the grounds upon which a call on a performance bond can be restrained, in particular the recent recognition of the Singapore Court of Appeal's ruling that "unconscionability" is a separate ground to restrain the call of a performance bond. This article examines the legal nature of an on demand performance bond and seeks to challenge the assumption that a performance bond is a mirror image of a letter of credit. These sample purchasing specifications were prepared by the George Washington University Center for Health Services Research and Policy (CHSRP) with support from the Commonwealth Fund. Technical guidance on the content of child development services was provided by experts from the Fund and researchers at Northwestern University’s Institute for Health Services Research & Policy Studies (IHSRPS). This document is intended as a tool to assist interested state officials in purchasing child development services from managed care organizations (MCOs) on behalf of children under age three who are eligible for Medicaid.
