This Comment will (1) summarize the antitrust litigation that put Peabody in jeopardy of losing its leases under section 27 of the Mineral Lands Leasing Act of 1920, and (2) criticize the decision of the Justice Department to forego a test case, thus drastically narrowing by administrative fiat the coal lease forfeiture provisions of the Mineral Lands Leasing Act.

Mineral Agreement In Developing Countries: Structures And Substance, David Nathan Smith, Louis T. Wells

Despite the many dramatic developments that have occurred over thepast half dozen years in relation to the production of natural resources insome areas of the third world, mineral production in most developingcountries is still carried out through contractual arrangements betweenforeign firms and host country governments. The nationalization of thecopper industry in Chile and the baudte industry in Guyana, the spectacularsuccesses of OPEC, and the completed or projected nationalizationsof petroleum operations in a number of countries have taken center stagesince 1969. Nevertheless, these developments are not typical of the vastmajority of mineral arrangements in developing countries.

The main purpose of this report is to present the geologic evidences of the existence of petroleum in the rocks along the foothills that form the western border of the San Joaquin Valley, Cal., between the Coalinga' oil district and Livermore Pass and to discuss the chances of finding oil in commercial quantity in this region. The mining districts of the Western or Cordilleran States are numerous and scattered over wide areas. The first attempt to locate all of them on a single map was carried out by the writer in 1907, with the aid of Mr. J. M. Hill and the statisticians in charge of the offices of the Survey at Denver, Salt Lake City, and San Francisco (Messrs. Chester Naramore, V. C. Heikes, and C. G. Yale). This map of the Western States was included in the annual volume of Mineral Resources of the United States. The large area covered and the necessity of …
