This article describes the origins and shaping of the classic text, with special emphasis on the goals of the authors and the developmental phase of clinical legal education from which their work emerged. The author surveys Gary Bellow's unique role and influence from the perspective of a contemporary, and identifies innovative teaching approaches that the text facilitated. Comments from law teachers over the years highlight the utility and importance of the book. To See Oneself As A Target Of A Justified Revolution: Thomas Jefferson And Gabriel's Uprising, William G. Merkel

William G. Merkel

Examines Jefferson's response to Gabriel's Uprising and argues that Jefferson employed the language of criminal theory in urging Virginia Governor James Monroe to spare the lives of convicted conspirators for the sake of justice and the state's image before the enlightened world. Jefferson's analysis of the slave rebels' acts and intentions makes clear that - at least in abstract, philosophical terms - Jefferson saw the slave uprising as justified, while he viewed white Virginia's resort to deadly force to counter the revolt as at best excusable.

The increasingly international reach of law owes part of its momentum to individual lawyers and law firms that function as carriers of ideas, processes and policies. U.S. lawyers are important participants in this expanding influence of law, as they educate, train and deploy individuals educated and licensed in the U.S. and abroad. This article examines the ways in which law firms internationalize, and considers the regulatory environment governing crucial interactions between U.S. and foreign-educated lawyers. Since the 1970s, feminism has helped transform the university and the production of knowledge. Not only have increasing numbers of female students, professors, and administrators entered universities, they have also created women's studies programs and courses, which have been slowly integrated into the various disciplines and university curricula. Further, feminism has spurred scholars to question traditional ways of knowing and teaching, academic disciplines, categorizations of knowledge, scholarly methodologies, and the university's separation from the broader community. Complex tensions that can occur during negotiations and decision-making are illustrated in the Supreme Court of Victoria decision in the case of Taphoohi v Lewenberg. Cases such as this place judges in the position of making decisions about 'proper mediator behaviour' and of making major policy decisions about professional diversity and standards.

What Federal Gun Control Can Teach Us About The Dmca's Anti-Trafficking Provisions, Alfred C. Yen

This article studies the so-called "anti-trafficking provisions" of the Digital Millennium Copyright Act ("DMCA") by drawing insight from federal gun control. Among other things, the anti-trafficking provisions criminalize the distribution of technology that circumvents the encryption schemes sometimes used to protect digital files. This prohibition even applies to the sale of circumvention technology for lawful purposes. Not surprisingly, this result has generated controversy. Consumer advocates and civil libertarians have argued that it is wrong to criminalize the sale of technology that has lawful use, particularly when that criminalization makes it difficult - if not impossible - for the public to …
