On June 22, 2009, after twenty-six years as the Executive Director of the Major League Baseball Players’ Association (MLBPA), seminal labor leader Donald Fehr announced his retirement. Fehr’s tenure at the MLBPA was marked by extreme highs – the average player salary increased from $241,000 to over $3 million – and lows – the cancellation of the 1994 World Series after the players went out on strike.
Shortly after announcing his retirement from the MLBPA, Fehr agreed to assist the National Hockey League Players’ Association (NHLPA) in revamping its constitution and finding a new executive director. For much of its …

Introduction: During the last several decades, international athletes' presence in professional American sports has reached unprecedented levels. Not all premier professional American sports leagues, however, accommodate internationalization to the same extent. While the National Football League (NFL), the National Hockey League (NHL), the National Basketball Association (NBA), and Major League Baseball (MLB) do not impose limits on international entrants into their leagues, Major League Soccer (MLS) does. Under a policy established at the league's founding in 1996 (the MILS Policy or the Policy), no MLS team may stock its twenty-person senior roster with any more than eight international players.

This article surveys and compares the legal sources and historical evolution of the Office of the Commissioner in the three major American professional sports (MLB, NBA, NFL). Part I introduces the appeal and relevance of studying the Commissioner’s office and describes the Article’s three-pronged analytical approach. Part II identifies and contrasts the legal foundations for the three sports’ varying scopes of commissioner authority. Part III takes a look at the various individuals who have filled the office in the past, and places them on a “power spectrum” according to the amount of power wielded by each. Part IV is a …

The purpose of the paper is to explore the minimum age policies of the Big Four sports leagues in the United States (NBA, NFL, MLB and NHL), and discuss the history of their policies. Emphasis is given to the legal battles waged by Spencer Haywood (NBA) and Maurice Clarett (NFL). A discussion of other sports and their minimum age policies is presented as well. The study and history of relevant antitrust law is incorporated as well.

This Article examines the role of situational pressures, fundamental attribution errors, and legal frameworks in how professional sports actors respond to the threat and occurrence of calamities. Both natural and manmade threats to American health are likely to rise over the next decade. Such threats may include catastrophic weather, natural disasters, terrorist attacks, and communicable disease pandemics. In response to these threats, professional sports leagues, professional athletes, fans, and media might engage in unprecedented behavior. Consider, for instance, increasingly-devastating weather patterns, and how they might animate leagues to relocate franchises to cities with more favorable forecasts. The same outcome might …
