Islamic Law And Women's Rights: Questioning The Validity Of The Reservations Invoking Islamic Law To The Convention On The Elimination Of All Forms Of Discrimination Against Women (Cedaw), Malak Khalil May 2008

Islamic Law And Women's Rights: Questioning The Validity Of The Reservations Invoking Islamic Law To The Convention On The Elimination Of All Forms Of Discrimination Against Women (Cedaw), Malak Khalil

Archived Theses and Dissertations

This thesis will attempt to demonstrate that the reservations invoking Islamic law to the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) are invalid. Reservations to human rights treaties in general are problematic, because these ones not only govern the relationship between States, but they also govern the relationship between the State and its citizens. Thus, finding a balance between state sovereignty, the pillar of international law and the rights of the people remains a challenge in the international arena. Another dimension of the argument is analyzing the validity of claiming Islamic law as a basis …

Integrity And Ethics In Western Adjudicatory Systems : Toward A Standard, Ruth S. Astle May 2008

Integrity And Ethics In Western Adjudicatory Systems : Toward A Standard, Ruth S. Astle

Theses and Dissertations

As a global community comes closer to a reality in which there is an international rule of law, a borderless standard of ethics and integrity in adjudication must be developed. Since the beginning of structured adjudication of disputes, ethics and integrity have been an integral part of the process. Even in biblical law, ethics and integrity are emphasized. Now, that many legal disputes, especially in the commercial arena including business and trade disputes, are being adjudicated between and among many different states and individuals from many different states, with many different formal and informal adjudicatory systems, the need for ethics …

The Right To Learn Across The Tracks: An Analysis Of School Funding And Integration In Seattle, Houston, Philadelphia, Chicago And Washington, D.C., Erin M. Pollard Apr 2008

The Right To Learn Across The Tracks: An Analysis Of School Funding And Integration In Seattle, Houston, Philadelphia, Chicago And Washington, D.C., Erin M. Pollard

Politics Honors Papers

Through examining the levels of integration in public and private schools across the United States, it is clear that the spirit of Brown v. Board of Education was never fulfilled. Students are still learning in an overwhelmingly homogeneous environment. Even in diverse neighborhoods there is a difference: the poor and minority children attend the public schools and the wealthy children attend private school. Thus, the urban public schools remain overwhelmingly minority, while private schools are overwhelmingly white. There is a clear discrepancy between black and white students in terms of size of school and quality of education.

To determine whether …

Reforming Copyright Law In The Digital Age: A Comparative Study Of The Legal Resolutions On P2p Transmission Between Taiwan And The United States, I-Hsien Chiu Apr 2008

Reforming Copyright Law In The Digital Age: A Comparative Study Of The Legal Resolutions On P2p Transmission Between Taiwan And The United States, I-Hsien Chiu

Theses and Dissertations

Adjusting legal system of copyright is vigorously in need in the twenty-first century. The abuse of technology has severely damaged the copyright-related industries not only in Taiwan, but also in the United States. Indeed, the lawsuits filed against modern P2P transmission are fairly unprecedented to courts when facing the tension between copyright holders and technology innovators. Therefore, the technological changes provide an enlightened motivation to develop the analysis on whether the approach that legislators and courts take would harmonize private property rights and public interests. Through the arguments, there are meaningful goals the study attempts to achieve. It is essential …

The sample size for this study was 886, which included only those officers who were married, had live-in partners, or were divorced/separated or widowed. From this sample, it was found that 7.9% of the Baltimore Police officers admitted to committing intimate partner violence and 8.4% admitted …

Generals In Three-Piece Suits—Contractors In Camouflage: A Critical Assessment Of Contractors In Iraq, Wyman E. Shuler Iii Apr 2008

Generals In Three-Piece Suits—Contractors In Camouflage: A Critical Assessment Of Contractors In Iraq, Wyman E. Shuler Iii

Graduate Program in International Studies Theses & Dissertations

Contractors compose part of the total force for U.S. warfare capability in Iraq.

Some augment U.S. warfare capability; others do not. Some of the contractors are controlled by the military; others are controlled by civilian (nonmilitary/political) government agencies. The problem: Who are the contractors and how has the nature of government oversight and control over contractors determined whether contractor contributions augment or diminish U.S. warfare capability in the Iraq War?

Argument: It is the degree of government control over contractors that determines whether the contractors' contributions have a positive or negative impact on warfare capability. Ultimately the findings support …

Assessment Of The Current Cultural Awareness And Training For The Air Force Contingency Contracting Officer, Reza A. Grigorian Mar 2008

Assessment Of The Current Cultural Awareness And Training For The Air Force Contingency Contracting Officer, Reza A. Grigorian

Theses and Dissertations

This study examined the current cultural awareness of contracting officers and the effectiveness of cross-cultural training provided to contracting officers through the Defense Acquisition University (DAU), and their monthly training at the base level. Current training in culture is fairly limited - only 2 days of the 9 day course in contingency contracting is dedicated to cultural training. Nevertheless, a comparison of means of 38 students before and after the DAU CON 234 course showed a statistically significant increase in Cultural Intelligence (CQ) on the cognitive and behavioral dimensions, but not on the motivational dimension. In addition, more experienced contracting …

Blending The Battlefield: An Analysis Of Using Private Military Companies To Support Military Operations In Iraq, Heather L. Gallup Mar 2008

Blending The Battlefield: An Analysis Of Using Private Military Companies To Support Military Operations In Iraq, Heather L. Gallup

Theses and Dissertations

Over the past fifteen years, the Department of Defense has experienced an increasing trend in the outsourcing and privatization of military operations. Key factors contributing to the growth include declines in military budgets, reductions in active duty end-strength, increases in operational deployments, advancements in weapon system technology, and evolutions in the nature of warfare. However, the continued escalation of incorporating Private Military Companies (PMCs) on the battlefield creates unique challenges. The purpose of this exploratory and descriptive research is to identify utilization rates, describe the types of roles being fulfilled, and synthesize the challenges of augmenting military manpower with civilian …

A Delphi Study Of Hipaa Compliance To Battlefield Medical Evacuation, John A. Chessman

Theses and Dissertations

The purpose of this research was to examine the impact of HIPAA compliance on the Battlefield Medical Evacuation process. Specifically, this thesis sought to answer three research questions addressing the current Battlefield Medical Evacuation process and current HIPAA considerations for each step of the process. The research questions were answered through the use of the Delphi Technique. Eight experts, representing Air Force, Army and Civilian medical communities participated in two rounds of the Delphi Technique. The research identified how HIPAA compliance is handled now and identified suggested improvements. An original model of the battlefield medical evacuation process was developed, and …

Balancing Government Risks With Contractor Incentives In Performance-Based Logistics Contracts, Christopher P. Gardner Mar 2008

Balancing Government Risks With Contractor Incentives In Performance-Based Logistics Contracts, Christopher P. Gardner

Theses and Dissertations

The use of Performance-Based Logistics (PBL) as a sustainment strategy for weapon systems has been mandated by the Department of Defense (DoD) and largely embraced by acquisition and contracting professionals in both government and private industry. Despite its apparent success, there is an inherent conflict that DoD implementers of PBL often face: the PBL goal of developing long-term partnerships that encourage investment from commercial partners is best achieved through lengthy, guaranteed contracts—but such contracts increase the DoD’s risk in an environment that is intended to transfer more risk to the contractor. This research examines issues associated with the type and …

An Analysis Of The Design-Build Delivery Method In Air Force Military Construction, James W. Rosner Mar 2008

An Analysis Of The Design-Build Delivery Method In Air Force Military Construction, James W. Rosner

Theses and Dissertations

The design-build method for construction project delivery continues to grow in both the private and public sector. Several government agencies have observed, through experience with design-build, positive results which give “anecdotal” credibility to design-build methods. The objective of this study is to compare the performance of the design-build delivery method with traditional design-bid-build approaches for Air Force (AF) military construction (MILCON). Data related to 835 (278 design-build, 557 traditional) MILCON projects were gathered from the Automated Civil Engineer System – Project Management Module (ACES-PM) for Fiscal Years 1996-2006. The design-build method had better performance for six of eight metrics with …

Too Much Freedom?: The Danger Of The "Liberal" Islamic Reform Project, Karl Christopher Procaccini Feb 2008

Too Much Freedom?: The Danger Of The "Liberal" Islamic Reform Project, Karl Christopher Procaccini

Archived Theses and Dissertations

Two approaches to Islamic law reform dominate the modern debate. Islamic "liberalists" seek to reinterpret sacred texts in the modern context, while Islamic "utilitarian's" pick and choose among the preexisting rules within the various schools of Islamic jurisprudence. While the liberal approach is often promoted as a path to a more progressive Islamic law, there is danger in adopting it as the "authentically Islamic" form of legal reform. In comparison with the alternative utilitarian approach, the liberal position offers a much wider scope for policy choice, in both progressive and reactionary directions. In a context of increasing conservatism, the extra …

Implementing Plain Language Into Legal Documents: The Technical Communicator's Role, Peggy Bivins Jan 2008

Implementing Plain Language Into Legal Documents: The Technical Communicator's Role, Peggy Bivins

Electronic Theses and Dissertations

This thesis discusses the benefits of using plain language in legal documents and the role technical communicators can play to help implement plain language. Although many definitions for plain language exist, it is best described as reader-focused communication that presents information in a manner that makes it easy for a reader to find, understand, and use the information. Plain language facilitates comprehension by using shorter, less complex sentences; active voice; and common words. All these elements aid in processing and understanding information, especially unfamiliar concepts. Laypeople, unversed in the law, frequently have difficulty understanding traditional legal writing. The complex sentences, …

El Conocimiento Y Aplicación Del Derecho Animal Como Herramienta En La Construcción De Una Medicina Veterinaria Integral, María Angélica Hoyos Botero

Medicina Veterinaria

Are De Jure Labor Laws Absolute? Formal Manufacturing In India, Gurmeet Singh Ghumman Jan 2008

Are De Jure Labor Laws Absolute? Formal Manufacturing In India, Gurmeet Singh Ghumman

Dissertations and Theses Collection (Open Access)

We investigate the view that de facto labor market conditions are important in evaluating the effects of labor institutions in developing countries where enactment does not necessarily imply enforcement. Using India as a case study we empirically investigate the effects of labor markets on the organized manufacturing sector from 1970 to 1997. Recognizing that the state can intervene in the outcome of labor disputes we construct a measure to proxy the degree of the state legislature's prejudice towards pro-worker causes. We argue that leftist and communist political parties can interfere in the resolution of disputes in favor of workers through …

Grievances: Issues And Interests That Drive Complaints Against American Sign Language / English Interpreters, Paula L. Gajewski Mickelson Jan 2008

Grievances: Issues And Interests That Drive Complaints Against American Sign Language / English Interpreters, Paula L. Gajewski Mickelson

Julie Belle White-Newman Award for Outstanding Research

It is essential to identify and examine the issues and underlying interests fueling disputes when pursuing a deeper understanding of conflict in the field of American Sign Language/English interpreting. This study analyzed grievances filed against interpreters within the RID Ethical Practices System to discover and understand more clearly the issues and interests igniting and escalating conflicts to the level of formal complaint. The conceptual context outlined decision-making models currently used in interpreter education and research, based in theories of conflict and dispute resolution, including a diagnostic tool and framework for identifying types of conflict and underlying interests. Document analysis of …

Eastphalia Rising: An Enquiry Into The Emergence Of An Asian Perspective On International Law And Global Governance, Sung Won Kim Jan 2008

Eastphalia Rising: An Enquiry Into The Emergence Of An Asian Perspective On International Law And Global Governance, Sung Won Kim

Maurer Theses and Dissertations

Interest in the possible impact of the rise of Asia in world affairs has been growing for a number of years. Asia’s emergence has become one of the most important developments in the post-Cold War international system, and it has drawn attention from scholars and practitioners who study the balance of power in international politics, the process of economic growth and competition, and the acceleration of globalization. Although definitions of what constitutes “Asia” differ, there is little disagreement that the epi-center for the rise of Asia sits in eastern and southeastern Asia, with China as the most prominent nation in …

Caribbean-China Relations: Foreign Policy And Small State Economic Adjustment, Dana Marie Morris Jan 2008

Caribbean-China Relations: Foreign Policy And Small State Economic Adjustment, Dana Marie Morris

Electronic Theses and Dissertations

In recent years the relationship between Caribbean states and China has intensified. This dissertation argues that the Caribbean's increased engagement with China is an important component of their economic adjustment strategy that was necessitated after changes in the orientation of the international economic system that they must operate within, particularly in relation to the loss of trade preferences and the sharp decline in official development assistance.

Despite the seemingly homogenous nature of these Caribbean states there is in fact significant foreign policy variation seen vis-à-vis engagement with China. Some Caribbean states have consistently recognized China, while others have vacillated between …

The Relationship Between Law Enforcement Officers And Child Welfare Social Workers, Cheryl Denise Gonzales, Aida Velia QuiñOnez

Theses Digitization Project

There has been a long established relationship problem between Child Protective Services (CPS) social workers and Law Enforcement (LE) officers. It is an issue of which both sides are aware, but neither has addressed this discord in an effort to improve collaboration between the two agencies. The purpose of this study is to help both Law Enforcement officers and Children Protection Services workers build a strong interdisciplinary relationship in child abuse cases.
