A Crise Económico-Financeira Europeia: Preconceitos E Realidades, Paulo Ferreira Da Cunha May 2012

A Crise Económico-Financeira Europeia: Preconceitos E Realidades, Paulo Ferreira Da Cunha

Hiding Behind The Cloak Of Invisibility: The Supreme Court And Per Curiam Opinions, Ira P. Robbins May 2012

Hiding Behind The Cloak Of Invisibility: The Supreme Court And Per Curiam Opinions, Ira P. Robbins

Ira P. Robbins

Per curiam--literally translated from Latin to "by the court"-is defined by Black's Law Dictionary as "[a]n opinion handed down by an appellate court without identifying the individual judge who wrote the opinion." Accordingly the author of a per curiam opinion is meant to be institutional rather than individual, attributable to the court as an entity rather than to a single judge The United States Supreme Court issues a significant number of per curiam dispositions each Term. In the first six years of Chief Justice John Roberts’ tenure, almost nine percent of the Court full opinions were per curiams. The prevalence …

Towards A Feminist Aesthetic Of Justice: Sarah Kane’S Blasted As Theorisation Of The Representation Of Sexual Violence In International Law, Honni Van Rijswijk May 2012

Towards A Feminist Aesthetic Of Justice: Sarah Kane’S Blasted As Theorisation Of The Representation Of Sexual Violence In International Law, Honni Van Rijswijk

Honni van Rijswijk

An ongoing question in feminist studies is whether there is such a thing as a legal feminist aesthetic. Many feminists argue that an aesthetic based on prescriptive or normative theories of form, derived from feminist politics, is an ‘impossibility’. We need to analyse the context and particularity of each form, and examine its political and cultural effects. While there is no particular form that can, a priori, be designated feminist, we can talk meaningfully about practices of representation, and methodologies, as being feminist or otherwise. This essay seeks to re-animate questions concerning the relationship between feminisms and representation, asking what …

The Proscription Of Incorporated Law Practices (Ilps) In Nigeria: The Legal And Constitutional Issues Arising, Abdullahi Saliu Ishola May 2012

The Proscription Of Incorporated Law Practices (Ilps) In Nigeria: The Legal And Constitutional Issues Arising, Abdullahi Saliu Ishola

Abdullahi Saliu Ishola

This paper critically examines the legality and constitutionality of the provision of Rule 5 sub-rule (5) of the Rules of Professional Conduct for Legal Practitioners, 2007 (the Rules), prohibiting the practice of law in Nigeria as a corporation. The appraisal is done on the scales of the provisions of Sections 40 and 42 of the 1999 Constitution of the Federal Republic of Nigeria, as amended (the Constitution), providing for rights to freedom of association and peaceful assembly and freedom from discrimination, respectively; on one hand, and, Section 18 of the Companies and Allied Matters Act (CAMA), allowing any two or …

You Say You Want A (Nonviolent) Revolution, Well Then What? Translating Western Thought, Strategic Ideological Cooptation, And Institution Building For Freedom For Governments Emerging Out Of Peaceful Chaos, Donald J. Kochan Mar 2012

You Say You Want A (Nonviolent) Revolution, Well Then What? Translating Western Thought, Strategic Ideological Cooptation, And Institution Building For Freedom For Governments Emerging Out Of Peaceful Chaos, Donald J. Kochan

Donald J. Kochan

With nonviolent revolution in particular, displaced governments leave a power and governance vacuum waiting to be filled. Such vacuums are particularly susceptible to what this Article will call “strategic ideological cooptation.” Following the regime disruption, peaceful chaos transitions into a period in which it is necessary to structure and order the emergent governance scheme. That period in which the new government scheme emerges is particularly fraught with danger when growing from peaceful chaos because nonviolent revolutions tend to be decentralized, unorganized, unsophisticated, and particularly vulnerable to cooptation. Any external power wishing to influence events in societies emerging out of peaceful …

Os Perigosos Sábios Do Sião I, Paulo Ferreira Da Cunha

Court Review: Volume 39, Issue 4 - Helping The Pro Se Litigant: A Changing Landscape, Paula Hannaford-Agor Mar 2012

Court Review: Volume 39, Issue 4 - Helping The Pro Se Litigant: A Changing Landscape, Paula Hannaford-Agor

Paula L Hannaford-Agor

For several years, judges, court staff, and a growing number of lawyers have recognized that at least one party is not represented by a lawyer in a sizeable portion of family law and smaller civil cases. Often both parties are self-represented. Two underlying factors associated with self-represented litigation— the relative scarcity of affordable legal services and an increased “do-it-yourself” attitude by many litigants—are fairly self-evident. What is less clear is how best to ensure that these litigants have sufficient access to the justice system to be able to resolve legal problems fairly and effectively. Courts and legal service providers have …

Court Review: Volume 44, Issue 1/2 – Editor’S Note, Alan J. Tomkins Mar 2012

Court Review: Volume 44, Issue 1/2 – Editor’S Note, Alan J. Tomkins

Alan J Tomkins

This special issue of Court Review focuses on procedural justice. Tom Tyler has called procedural justice the most powerful explanatory concept for why people obey rules that restrict their behavior in ways they would otherwise find unacceptable. David Rottman has written “having a sense that court decisions are made through processes that are fair is the strongest predictor by far of whether members of the public approve of or have confidence” in courts. Procedural justice is worthy of a deep look, and this issue of Court Review does precisely that—it presents papers from some of the nation’s leading scholars who …
