Border Crossings: Nafta, Regulatory Restructuring, And The Politics Of Place, Ruth Buchanan
Indiana Journal of Global Legal Studies
Professor Buchanan begins her paper by questioning whether
recent economic and political shifts towards notions of
"globalization" (e.g., the NAFTA) have failed to consider the
politics or economics of change in particular places. Her prime
example of a "place" where integration is illogically forced against
a background of differentiation is the U.S.-Mexico border region.
Through the scope of a "regulatory complex" (a complex of legal,
institutional, regulatory, and social orderings), she departs from the
common view of the NAFTA as a productive tool of North American
integration, and instead views the NAFTA as exacerbating
"differences between localities, industries, and labor …

A Global Perspective On Current Regulatory Reform: Rejection, Relocation, Or Reinvention?, Alfred C. Aman

Dean Alfred Aman 's article addresses recent U.S.
administrations' attempts at regulatory reform and notes that as far
as the actual reforms are concerned, there are more similarities
over time than differences. The globalization of politics and
markets and manufacturing, in particular, has helped create global
political economic forces that militate in favor of various forms of
deregulation and privatization not only in the United States, but in

In this article Mr. Bill Maurer addresses a fundamental tension
at work in the British Virgin Islands: while British Virgin Islanders
(BVIslanders) proudly term themselves a "law and order" people
and seek to distinguish themselves from other Caribbean peoples,
the territory remains as wedded as ever to its British rulers and the
West. Mr. Maurer first notes that when a colonial people begins to
view itself as essentially different from its rulers, it may begin a

Beyond National Law: The Neglected Role Of The International Law Of Personal Jurisdiction In Domestic Courts, Andrew L. Strauss

When one of the parties is foreign in civil personal jurisdiction cases, United States courts have assumed it appropriate to overlook international jurisdiction law and apply solely United States constitutional, statutory and common law doctrines related to jurisdiction. Courts in other countries likewise apply their own domestic doctrines of jurisdiction in international cases. Applying both positivist and normative methodologies, this article makes the theoretical case that the international law of personal jurisdiction should be applied in domestic courts.

Presidential Philosophies And American Foreign Policy: From The Long Telegram To The New Look, John R. Moore

American foreign policy often undergoes alteration as presidential administrations change. After World War II president Harry S. Truman and President Dwight D. Eisenhower both implemented a foreign policy aimed at containing the Soviet Union, but the philosophical underpinnings of their foreign policies differed greatly. While the demands of partisan and international politics account for some of this difference, the impact on foreign policy of the two men's personalities deserves attention and investigation. In other words, how did the individual backgrounds, personal beliefs and world views of Truman and Eisenhower dictate their approach to foreign policy? The source used in this …

Charting The Law Of Maritime Boundaries, W. P. Gormley
Vanderbilt Journal of Transnational Law
When faced with disputes concerning maritime boundaries, one must analyze an array of materials, including: unilateral state practices, bilateral boundary agreements, multilateral regional conventions, the major international conventions--particularly the Law of the Sea Conventions of 1958 and the 1982 United Nations Law of the Sea Convention -- and customary international law. Beyond question, this huge corpus of material appears overwhelming to most practitioners and scholars when they attempt to resolve maritime disputes. Faced with such a daunting task, scholars, practitioners, and judges may want to consult International Maritime Boundaries, a brilliantly executed research project that analyzes 134 maritime boundaries.
