This thesis is about the Supreme Court case Roe v. Wade and how the Court in Roe ruled a child as a “potential to life.” The Fifth and Fourteenth Amendments show that there is an expectation of privacy in regards to a woman and her doctor but it is questionable as to whether or not the expectation of privacy can cover the fetus in the womb. The question raised next is whether or not the woman has complete rights to the fetus and whether or not she can decide if the fetus has a right to live or not. Coming …

This work undertakes an examination of the social and legal problems associated with abortion in the United States today. Lader begins by discussing an incident which attracted considerable newspaper coverage in 1962-Sherri Finkbine's futile efforts to obtain a legal abortion in America after taking the drug thalidomide, which gravely deforms the fetus in a high percentage of cases.The author expresses regret that an American doctor did not perform an abortion upon Mrs. Finkbine and then inform the authorities of his action, thereby making the matter a test case. Parents, Judges, And A Minor's Abortion Decision: Third Party Participation And The Evolution Of A Judicial Alternative, William Green

This article will examine the Supreme Court's modification of Roe v. Wade to permit third party participation in a minor's abortion decision-making: how it originated, what direction it has taken and at whose initiative, and what issues remain. This article will argue that the Court's difficulty in resolving this issue resulted from the justices' disagreement over what recognition, if any, should be given to the minor-related interests that states have asserted to support third party involvement. This article will also argue that the Court's eventual ability to reach agreement was due primarily to the policy leadership of Justice Powell. Part …

This Note examines the evolution of El Salvador’s existing penal code, specifically focusing on the abortion legislation. Further, it examines the significance of The Case of Beatriz and it suggests reform for El Salvador’s government to include exceptions in their penal code, similar to exceptions available in the United States, to provide women with access to safe abortions in extreme circumstances. Despite similarly progressive abortion rights laws, women in South Africa and the U.S. experience completely different levels of access to legal and safe abortions. In this paper, I will seek to explain the reasons for this disparity by describing the ways in which natural law has influenced the application of law in the U.S. and South Africa while examining the role of cultural values in the realization of abortion rights. In Artavia Murillo v. Costa Rica, the Inter-American Court on Human Rights examined the question of whether Costa Rica may, under the American Convention on Human Rights, protect human embryos from destruction by banning in vitro fertilization (IVF) in its jurisdiction. The case provoked the Inter-American Court of Human Rights' first debate on the existence of international human rights obligations to authorize and fund artificial reproductive technologies as well as its first interpretation on the right to life from conception, established in Article 4(1) of the American Convention. Laws prohibiting abortion and laws allowing it under certain circumstances coexist in Latin America and Caribbean. This paper examines whether these sets of norms evince any consistencies in the region as a whole and whether recent trends in legislation and jurisprudence favor recognition of abortion rights. The paper carries out a comparative analysis of relevant Latin American and Caribbean national constitutions, primary laws (i.e. laws that prevail over lesser regulations or administrative directives), domestic jurisprudence and high court decisions on abortion. Even though non-judicial international human rights bodies routinely promote the understanding that the Convention on the Rights of the Child and the American Convention on Human Rights mandate the legalization of abortion, states parties have authoritatively interpreted their treaty obligations otherwise. This article examines, in particular, evidence of Latin American and Caribbean states’ interpretation of these treaties as recognizing and protecting the unborn child’s right to life and health in a comprehensive manner, as well as evidence of their rejection of abortion rights in international fora. Although several commentators have previously suggested that the United States and Germany now share more commonalities than differences, this Article challenges the conventional wisdom by suggesting that the United States and Germany have moved in the opposite direction on a spectrum of available abortion services. In the United States, the constitutional right to an abortion is unrealizable for many women due to restrictive state and federal laws and the absence of providers in many areas. In Germany, by contrast, despite the country’s formal recognition of fetal rights, early abortion is widely available and often funded by the government. In short, …

Magazines, television advertisements, and billboards featuring women show us how we have achieved independence, wealth, desirability, and our intelligence. We are no longer the supporting role in movies and entertainment but stars in our own right. This Article explores a little-noticed dimension of abortion and assisted suicide (or voluntary euthanasia): how choosing to reject those options can have a negative impact on the legally authorized choosers. Women who refuse abortion may be blamed for their choice by boyfriends, neighbors, employers, and others. Similarly, infirm or dying persons may find family and other caregivers upset by their refusal to agree to assisted suicide when voluntary death seems the sensible option. This article examines the question of whether the Inter-American system of human rights has effectively applied article 4(1) the American Convention on Human Rights (hereinafter American Convention or Convention), which protects the right to life from the moment of conception and, if so, to what extent. The paper carries out a critical assessment of the Inter-American system’s current application of article 4(1), which stands out among other international human rights treaties for its explicit recognition that human life begins at conception and for its unequivocal protection of the unborn child’s right to life in utero. Not many are aware Roe v. Wade and Doe v. Bolton were challenged before the Inter-American Commission on Human Rights (IACHR) in 1981. In Baby Boy v. United States, the quasi-judicial regional human rights body concluded that the abortion of Baby Boy, a viable male fetus, was permissible under the American Declaration of the Rights and Duties of Man and, incidentally, the American Convention on Human Rights, notwithstanding the fact that the latter protects the right to life "from the moment of conception" and the former contains an implied right to life for every "human being". Many of the legal and policy issues about which people today get most exercised turn on a little-understood relationship between two fundamental principles. On one hand is the principle of autonomy, which, for reasons explored in this article, is often employed in defense of greater freedom and less government intervention in matters of morals and self-harmful conduct. On the other hand is respect for basic goods, those ends and purposes that constitute ultimate, underived, and intelligible reasons for rational action, and which include knowledge, human life, and community, among others. Este ensayo argumenta que el fracaso de nuestros debates públicos sobre el aborto y la investigación destructora de embriones se debe, en gran parte, no a distintas valoraciones de la vida humana individual sino a distintas concepciones e intuiciones acerca del proceso de gestación. Un grupo lo trata como un proceso de construcción y el otro como un proceso de desarrollo. Se muestra que estos dos incompatibles modelos de reproducción explican las distintas posturas que por lo general se encuentran en los debates sobre la vida. Women in Canada are at risk of abortion becoming increasingly difficult to access. In its landmark 1988 ruling, R. v. Morgentaler, the Supreme Court of Canada struck down the prohibition of abortion in section 251 of the Criminal Code on the grounds that it violated a section of the Charter of Rights and Freedoms which guarantees, among other things, "security of the person". However, all of the justices who ruled that section 25 unconstitutional nonetheless claimed that protecting the fetus is a valid objective of federal legislation, leaving open the possibility that a different and carefully crafted law against abortion …
