Addiction And Liberty, Matthew B. Lawrence

This Article explores the interaction between addiction and liberty and identifies a firm legal basis for recognition of a fundamental constitutional right to freedom from addiction. Government interferes with freedom from addiction when it causes addiction or restricts addiction treatment, and government may protect freedom from addiction through legislation empowering individuals against private actors’ efforts to addict them without their consent. This Article motivates and tests the boundaries of this right through case studies of emergent threats to liberty made possible or exacerbated by new technologies and scientific understandings. The COVID pandemic has changed the world in ways, both large and small, forever. One unexpected way the world changed was when live sports suddenly went dark and esports began experiencing attention from betting audiences that were suddenly starving for content.1 Esports also received a second glance from gaming regulators. And, though not exactly suddenly (even though it felt like it), approvals for wagering on esports were granted in a variety of jurisdictions, most notably Colorado and Nevada.2

As part of federal and state relief programs created during the COVID-19 pandemic, many American households received pauses on their largest debts, particularly on mortgages and student loans. Others may have come to agreements with their lenders, likewise pausing or altering payment on other debts, such as auto loans and credit cards. This relief allowed households to allocate their savings and income to necessary expenses, like groceries, utilities, and medicine. But forbearance does not equal forgiveness. At the end of the various relief periods and moratoria, people will have to resume paying all their debts, the amounts of which may …

The emerging trend of loot boxes in video game platforms continues to expand the shifting boundaries between the real and virtual world and presents unique insights into the impact each world should have on the other. Borrowing their design from the gambling industry, loot boxes operate as a hybrid between slot machines and trading cards. A consumer pays real-world money to buy a virtual box without knowing its contents. Upon opening the box, the consumer receives a virtual good that may be of great value, but more commonly is of little or no value.

Talking About Casino Gambling: Community Voices From Boston Chinatown, Carolyn Wong, Giles Li

This pilot study examined the casino gambling practices of residents and workers in Boston Chinatown. The aim was to learn about the trajectory and life context of individual participants’ gambling activity, including how individual participants describe their motivation, nature and frequency of gambling, and its effects on self and family. The research was conducted by a university based research team in partnership with the Boston Chinatown Neighborhood Center, and with the assistance of the Massachusetts Council on Compulsive Gambling.
The stories told by participants illustrate multiple and overlapping risk factors for problem gambling. Our conceptual approach took into account the …

Texas takes pride in its unique Western heritage and its adventurously independent spirit. However; the Texas Legislature has spurned a widely popular and uniquely Texan pastime, Texas Hold 'E. Despite praising Texas's cultivation of Texas Hold 'Em, Texas low condemns participation in the game to the secrecy of Texans homes. Tronically, while maintaining an allegedly strict stance against commercial gambling, Texas manages its own lottery and administers pari-mutuel wagering on dog and horse racing tracks.

This article discusses the impact Nevada has had on legal regulated sports betting for the past seventy years. First, an overview and history of Nevada's sport betting regulatory framework will be presented; and, second, lessons learned and issues to consider for states wishing to embark on legalized regulated sports betting such as, integrity, why states and not the federal government should regulate sports betting, how tax rates and fees impact the legal and illegal markets, why technology is critical component of legal sports wagering, why multiple avenues for consumer protection are essential, and finally how cooperation among all stakeholders is …

Becky Harris, appointed by former Nevada Governor Brian Sandoval (2011-2019), served as the first female Chair of the Nevada Gaming Control Board from January 2018 to January 2019. Harris was the first Chair to propose regulations addressing workplace sexual harassment. Prior to serving as Chair, Harris served in the Nevada Legislature for the 2015 and 2017 legislative sessions.

The Court determined that application of NRS § 463.120(6), as enacted in 2017 through Senate Bill 376, which protects certain information and data provided to the gaming authorities, does not apply to information requested before the effective date of the statute. From the plain language of the act that the privilege applies to “any request made on or after the effective date of this act,” the Court concluded that the privilege applies prospectively only and does not apply to any request made before the effective date of this act.

Gaming activities play important social, cultural, and economic roles for many Native American tribes. During the 1970s and 1980s, gaming activities spread throughout the country, and became more accessible to nonnative individuals. This growth in gaming activities drew the attention of state and local officials who sought to limit and regulate Native American gaming. In California v. Cabazon Band of Mission Indians, the State of California, arguing before the Supreme Court, asserted that it could exercise jurisdiction over Native American gaming activities. In a stunning defeat, the Supreme Court ruled against the State of California when it announced its decision …

In May 2013, the American Psychiatric Association released the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders (“DSM-5”). Among other changes, the DSM-5 includes new entries for hoarding disorder and premenstrual dysphoric disorder as well as a reclassified entry for gambling disorder. Using these changes as examples, this Article examines the implications of the DSM-5 for key issues in health law, including health insurance coverage, public and private disability benefit eligibility, and disability discrimination protection. What began with a poker club on an isolated Indian reservation in the California desert now rivals the commercial casino industry. While Indian casinos have rapidly transformed native and non-native communities across North America, their growth entails indigenous traditions practiced for millennia. For the Cabazon Band, who opened that first poker club and later defended it before the Supreme Court, gambling is linked to their tradition of self-determination. In fact, the Cahuilla nations, which include the Cabazon Band, continue to exert cultural practices that have significantly altered California's development since the arrival of Europeans, even during state-endorsed genocide. Lost In The Shuffle: How Health And Disability Laws Hurt Disordered Gamblers, Stacey A. Tovino

Gambling disorder is not a legally sympathetic health condition. Health insurance policies and plans have long excluded treatment for gambling disorder from health insurance coverage. Individuals with gambling disorder who seek disability income insurance benefits from public and private disability income insurers also tend not to be successful in their claims. In addition, federal and state antidiscrimination laws currently exclude individuals with gambling disorder from disability discrimination protections. This Article is the first law review article to challenge the legal treatment of individuals with gambling disorder by showing how health insurance and antidiscrimination laws hurt problem gamblers.
