O presente artigo visa a discutir e demonstrar a forma historicamente paternalista com que o ordenamento pátrio trata seus cidadãos, ilustrando a tese por meio do tratamento jurídico dado aos maiores de 60 anos que, a despeito de serem absolutamente capazes, não têm direito a escolher o regime patrimonial de eventual união conjugal, devendo adotar, obrigatoriamente, o de separação total, sob os argumentos de proteção aos idosos contra golpistas e da expectativa de herança da família anterior.
