Of Patents And Path Dependency: A Comment On Burk And Lemley, R. Polk Wagner

This Article delves into issues surrounding the relationship between technology and the patent law. Responding to Dan Burk and Mark Lemley's earlier article, Is Patent Law Technology-Specific?, the piece notes that the basic question posed by Burk and Lemley's article is a relatively easy question given the several doctrines that explicitly link the subject matter context of an invention to the validity and scope of related patents. This sort of technological exceptionalism (which this Article refers to as micro-exceptionalism) is both observable and easily justifiable for a legal regime directed to technology policy. Over the last several years there have been a number of calls for the development of a new theoretical doctrine to govern the force structure of the United States military. The last big change in doctrine occurred in the post-Vietnam era. It involved not simply the change to the all-volunteer force, but an abandonment of escalation brinkmanship and open-ended missions. The subsequent Powell Doctrine demanded the use of overwhelming force and clear objectives and boundaries for military intervention. Computer technology has developed within the last decades with many advancements which require intellectual property protections. This thesis addresses the need for the legal protection of software by the vast body of copyright laws. This thesis examines the history, nature, textual and practical compositions of copyright laws and their adaptability to computer technology. The thesis further analyses the scope of copyright protection with emphasis on the Computer Software Copyright Act of 1980 (CSCA), the regime of international conventions for the protection of software as well as other statutory protections for the owners and users of the software. Dickey-Lincoln School Lakes Project
The Dickey-Lincoln Hydroelectric Dam is a water resources project proposed by the Federal Government (U. S. Army Corps of Engineers). Therefore, in accordance with the National Environmental Policy Act, the Corps of Engineers is required to prepare an environmental impact statement (EIS) on the project. A federal plan or project such as Dickey-Lincoln should take into account its effect upon man's health, safety, welfare and economic well-being, as well as effects upon the surrounding environment. More importantly, project plans should be evaluated in a "manner calculated to encourage harmony between man and his environment." In other words, project plans or …
